BILL NO. ~t~"~ ORDINANCE NO. ~L~qS'' <br /> <br /> AN ORDINANCE AMENDING CHAPTER 15.16 OF THE UNIVERSITY <br /> CITY MUNICIPAL CODE, RELATING TO FLOODPLAIN MANGEMENT, <br /> BY REPEALING CHAPTER 15.16 AND ENACTING IN LIEU THEREOF A <br /> NEW CHAPTER TO BE KNOWN AS "CHAPTER 15.16 FLOODPLAIN <br /> MANAGEMENT," THEREBY AMENDING SAID CHAPTER SO AS TO <br /> MEET CURRENT NATIONAL FLOOD INSURANCE PROGRAM <br /> CRITERIA; CONTAINING A SAVINGS CLAUSE AND PROVIDING A <br /> PENALTY. ~ <br /> WHEREAS, at its meeting held at City Hall at (a: :30 ~.a,.on ~ ~',.~ ~, 2004, the <br />University City Plan Commission recommended an amendment of Cliapter 1 ~..16 of the University City <br />Municipal Code so as to meet current National Flood Insurance Program criteria; and <br /> <br />WHEREAS, due notice of a l~ublic hear/n~ to be held by the City Council in the City Council <br />Chambers at City Hall at 7:30 p.m. on . .{.1,11~ {t~ ,2004, was duly published in the St. Louis <br />Countian, a newspaper of general circulation" '"within said City on ~"t~,tt ~-~ ,2004, which was at <br />least 20 days prior to the public hearing; and ~ <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in said notice, and all <br />suggestions or objections concerning said amendment were duly heard and considered by the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI AS FOLLOWS: <br /> <br /> Section 1. Chapter 15.16 of the University City Municipal Code, relating to floodplain <br />management, is hereby amended by repealing Chapter 15.16 and enacting in lieu thereofa new chapter to be <br />known as "Chapter 15.16 Floodplain Management," thereby amending said chapter so as to meet current <br />National Flood Insurance Program criteria; so that Chapter 15.16, as so amended, shall read as follows: <br /> <br />Article 1 Authorization, Findings of Fact, and Purposes <br /> <br />Section 15.16.010 Authorization. <br /> <br />The General Assembly of the State of Missouri has delegated the responsibility to local governmental <br />units to adopt floodplain management regulations designed to protect the health, safety, and general <br />welfare, pursuant to Section 82.010 RSMo for a constitutional charter city such as University City, or Section <br />89.020 RSMo. Therefore, the City Council of the City of University City, Missouri, ordains as follows. <br /> <br />Section 15.16.020 Findings of fact. <br /> <br />1 ~ Flood Losses Resulting from Periodic Inundation <br /> <br />The special flood haza{d areas of the City are subject to inundation which results in loss of life and <br />property, health and safety hazards, disruption of commerce and governmental services, extraordinary <br />public expenditures for flood protection and relief, and impairment of the tax base; all of which <br />adversely affect the public health, safety mad general welfare. <br /> <br />2. General. Causes of the Flood Losses <br /> <br />These flood losses are caused by (I) thc cumulative effect of development in any delineated floodplain <br />causing increases in flood heights and velocities; and (2) the occupancy of flood hazard areas by uses <br /> <br /> <br />
