ORDINANCE NO. <br /> <br />AN ORDINANCE AMENDING CHAPTER 2.52 OF THE UNIVERSITY <br />CITY MUNICIPAL CODE, RELATING TO THE COMMITTEE FOR <br />ACCESS AND LOCAL ORIGINATION PROGRAMMING, BY <br />REPEALING SECTION 2.52.050 THEREOF, RELATING TO <br />MEMBERSHIP AND APPOINTMENT, AND ENACTING IN LIEU <br />THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 2.52.050 <br />MEMBERSHIP AND APPOINTMENT," THEREBY AMENDING SAID <br />SECTION SO AS TO INCREASE THE NUMBER OF VOTING <br />MEMBERS FROM FIVE TO SEVEN, AND IDENTIFY THE CURRENT <br />FRANCHISEE; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 2.52 of the University City Municipal Code, relating to the <br />Committee for Access and Local Origination Programming, is hereby amended by <br />repealing Section 2.52.050 thereof, relating to membership and appointment, and <br />enacting in lieu thereof a new section to be known as "Section 2.52.050 Membership and <br />appointment," thereby amending said section so as to increase the number of voting <br />members from five to seven, and identify the current franchisee; so that said section, as <br />so amended, shall read as follows: <br /> <br />2.52.050 Membership and appointment. <br /> <br />CALOP shall consist of seven voting members, appointed by the city council, who shall <br />each serve a three-year term. At least one of the seven voting members shall be selected <br />from a group of at least three nominees submitted to the city council by Charter <br />Communications Entertainment I, LLC, hereinafter referred to as the "company." The <br />remainder of the members shall be selected by the city council upon the recommendation <br />by either members of the city council, city staff or any resident citizen of the city. In <br />addition to the seven voting members of CALOP there shall be four nonvoting ex officio <br />members; one will be the city manager or the city manager's duly appointed <br />representative; one will be a member of the city council; one will be appointed by the <br />company; and one will be appointed by the University City School District. Ex officio <br />members shall receive all minutes of all meetings of CALOP, and may submit written <br />reports and recommendations. Ex officio members may comment during any public <br />discussion segment of any meeting. <br /> <br /> Section 2. This ordinance shall not be construed so as to relief any person, <br />firm or corporation from any penalty heretofore incurred by the violation of Chapter 2.52, <br />Section 2.52.050, nor bar the prosecution for any such violation. <br /> <br /> <br />
