AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE <br />OF THE CITY OF UNWERSITY CITY, RELATING TO ZONING, BY <br />REPEALING SECTION 34-40.7(3) AND SECTION 34-57.4(b) THEREOF <br />RELATING TO DENSITY IN THE PD DISTRICT AND RELATING TO <br />COMMON OPEN SPACE IN THE PD DISTRICT, AND ENACTING IN LIEU <br />THEREOF NEW SECTIONS TO BE KNOWN AS "SECTION 34-40.7(3) <br />PLANNED DEVELOPMENT-RESIDENTIAL (PD-R)," AND AS "SECTION <br />34-57.4(b)" BY AMENDING SAID SECTIONS SO AS TO ALLOW FOR <br />DISCRETIONARY DENSITY FLEXIBILITY IN THE PD DISTRICT AND TO <br />ALLOW FOR DISCRETIONARY COMMON OPEN SPACE <br />REQUIREMENTS IN THE PD DISTRICT; CONTAINING A SAVINGS <br />CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> WHEREAS, at its meeting held at City Hall at 7:30 p.m. on September 22, 2004, the <br />University City Plan Commission recommended an amendment of Section 34-40.07(3) and <br />Section 34-57.4(b) of the University City Zoning Code by adding provisions to allow for <br />discretionary density flexibility in the PD District and allow for discretionary open space <br />requirements in the PD District; and <br /> <br /> WHEREAS, due notice of public heatings to be held bX the City Council in the City <br />Council Chambers,~at ~City Hall at 7:39.,p.m. on N~~v~ 1, ~l]f)[,£ , was duly <br />published in the ~ ~-. ~c~,x5 , ~t newsp~p-e'r c;i'-g~nerhl circulation within said <br />City; and ' <br /> <br /> WHEREAS, said public hearings were held at the time and place specified in said notice, <br />and all suggestions or objections concerning said amendment were duly heard and considered by <br />the City Council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, <br />relating to zoning is hereby amended by repealing Section 34~40.7(3), relating to density in the <br />PD District and by repealing Section 34-57.4(b), relating to common open space in the PD <br />District, and enacting in lieu thereof new sections to be known as: "Section 34-40.7(3) Planned <br />Development-Residential (PD-R)," and "Section 34-57.4(b)"by amending said sections so as to <br />allow for discretionary density flexibility in the PD district and to allow for discretionary <br /> <br />K..
