BILL NO. AN ORDINANCE GRANTING, SELLING AND CONVEYING TO THE METROPOLITAN ST. LOUIS SEWER DISTRICT AN EASEMENT IN HEMAN PARK. WHEREAS, the City of University City, Missouri (the "City") is expanding its Heman Park Recreation Center (the "Center"); and WHEREAS, a storm sewer in Heman Park must be relocated for the Center to be expanded as planned; and WHEREAS, the Metropolitan St. Louis Sewer District has requested an easement in Heman Park to relocate the storm sewer; and WHEREAS, the easement will further the preservation of the health, safety, morals and general welfare of the people of the City; and WHEREAS, the City is willing to grant, sell and convey the requested easement to the Metropolitan St. Louis Sewer District. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1: The City of University City, Missouri is the owner of property shown on the attached Easement Plat marked Exhibit "A" and made a part hereof, and more fully described as follows: Blocks 3, 5 and 17 of Central Suburbs, Plat Book 7, Page 23 in University City, St. Louis County, Missouri. Locator number 17J-23-0554. Section 2. In consideration of the sum of one dollar ($1.00) and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of University City hereby grants, sells and conveys an easement in said property shown on Exhibit "A" to the Metropolitan St. Louis Sewer District, subject to fhe terms and conditions set forth in the Easement marked Exhibit "B" and made a part hereof. Section 3. The City Manager of the City of University City is hereby authorized and directed to enter into and execute said Easement on behalf of the City of University City. Section 4. This ordinance shall take effect and be in force from and after its passage as provided by law. PASSED [~- dayof ~--~~ ,2004
