Residential ("PD-R"). The following land uses and developments may be permitted in said PD- <br />R district, subject to the issuance of a conditional use permit: Dwellings, Garden Apartments. <br /> <br /> Section 2. Said properties at 965 Midland and 7201 Balson are more fully described as <br />follows: <br /> <br />Lots 1, 2, 30 and 31 in Block 2 of Balson's Subdivision of Shaftsbury Heights, as <br />recorded in Book 10 Page 03 St. Louis County Records, Missouri, less and excepting <br />therefrom the South 10.00' taken for widening of Balson Avenue by Condemnation Suit <br />No. 69527 of the Circuit Court of St. Louis County, Missouri, being more particularly <br />described as: Beginning at Southeast comer of Lot 3 in Block 2 of Balson's Subdivision <br />of Shaftsbury Heights; thence North 07 Degrees 06 Minutes 53 Seconds East, 124.00'; <br />thence, North 82 Degrees 53 Minutes 07 Seconds West, 50.00'; thence, North 07 <br />Degrees 06 Minutes 53 Seconds East, 134.00'; thence, South 82 Degrees 53 Minutes 07 <br />Seconds East, 44.09'; thence, South 12 Degrees 59 Minutes 07 Seconds East, 120.28'; <br />thence, along a curve to the right having a length of 156.81' and a radius of 350.43'; <br />thence, South 07 Degrees 06 Minutes 54 Seconds West, 10.00'; thence, North 82 <br />Degrees 53 Minutes 07 Seconds West, 112.52' to the place of beginning, containing <br />18,601 square feet or 0.43 acres, more or less. <br /> <br />The above described tract a t 9 65 Midland h as a S t. Louis County 1 ocator n umber o f <br />17J211007. <br /> <br />The above described tract at 7201 Balson has a St. Louis County locator number of <br />17J211425. <br /> <br /> Section 3. The new Official Zoning Map of University City is attached hereto, marked <br />Exhibit "A", and incorporated herein by this reference thereto. <br /> <br /> Section 4. By Resolution No. ~¢(5t l0 ~i~t[e City Council approved a preliminary <br />development plan for 965 Midland and 7201 Balson, known as "Heman Park Condominiums," <br />and authorized the preparation of a final development plan. See Conditional Use Permit <br />P040011. A final development plan and plat(if applicable) must be approved by the City <br />Council prior to the issuance of any building permits in connection with the development. The <br />number and type of dwelling units authorized, including the number of bedrooms per dwelling <br />unit by type, shall be as permitted for the zoning classification of Dwellings, Garden Apartments, <br />and consistent with Conditional Use Permit P040011; except that the maximum number of <br />dwelling units shall not exceed ten and the maximum number of bedrooms per dwelling unit <br />shall not exceed two. <br /> <br /> Section 5. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation frOm any penalty incurred by the violation of Chapter 34, nor bar the prosecution of <br />any such violation. <br /> <br /> Section 6. Any person, firm, or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalties provided in Chapter 34, <br /> <br /> <br />
