G <6'lb3 ORDrnANCENO. ~ AN ORDrnANCE V ACATrnG AND SURRENDERING A PORTION OF A TWENTY FOOT WIDE EAST-WEST ALLEY LOCATED rn BLOCK 7 OF THE AMENDED PLAT OF ROTH GROVE SUBDIVISION, BUT RESERVrnG ANY PUBLIC EASEMENTS, IF ANY, AND DIRECTrnG THAT THIS ORDrnANCE BE RECORDED rn THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, the portion of the above 20 foot wide alley is public right-ofway in the Roth Grove Subdivision in University City, in St. Louis County, Missouri; and WHEREAS, due notice of public hearing to be held by the City of University City at the Council Chambers at City Hall on March 7, 2005 at 7:30 p.m., to hear any comments concerning the proposed vacation of said alley right of way, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on February 18, 2005. WHEREAS, said public hearing was held at the time and place specified in said notices, and all comments concerning the vacation of said alley right of way were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The portion of an east-west 20 foot wide alley being vacated is in block 7 of the AMENDED PLAT OF ROTH GROVE, a subdivision within the City of University City in S1. Louis County, Missouri, and all of the City of University City's right and title therein is hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; and the said parcel is more specifically described as follows: The portion of said alley being vacated is approximately 20 feet wide by 116.42/ 128.54 feet long, is irregularly shaped, and is located adjacent to the south line oflot 19 in block 7 of the AMENDED PLAT OF ROTH GROVE SUBDNISION, and is adjacent to the north line oflots 1 through 5 of block 7 of the AMENDED PLAT OF ROTH GROVE SUBDNISION. ROTH GROVE SUBDNISION is located within the City of University City and recorded in Plat Book 19, on page 7 of the records of the S1. Louis County Recorder of Deeds. The boundaries of the parcel being vacated are more particularly described as follows: Beginning at a point on the south line of said alley at the northwest comer of lot 5 of block 7 of the AMENDED PLAT OF ROTH GROVE SUBDNION; thence along the northern prolongation of the west line oflot 5 and leaving the south line of said alley north 38 degrees 19 minutes 00 seconds east a distance of 20 feet to a point on the north line of said alley, being also on the south line oflot 19 of block 7 of the AMENDED PLAT OF ROTH GROVE SUBDNISION; thence along the south line of lot 19 and along the north line of said alley south 51 degrees 41 minutes 00 seconds east a distance of 116.42 feet to its intersection with the west line of former Purcell Avenue, 24 feet wide, vacated by Ordinance Number 6264 recorded in Book 12733, page 2290
