<br />Section 3. The new Official Zoning Map of the City is attached hereto, marked Exhibit <br />"A", and incorporated herein by this reference thereto. <br /> <br />Section 4. By Resolution No. 03~6SW' , the City Council approved a preliminary <br />development plan for 8041 Olive, 8081 Olive and 1214 Hafner, known as "Addition To Olive <br />. Farmer's Market," and authorized the preparation of a fmal development plan. See Preliminary <br />Development Plan Application P040039/40. A fmal development plan and plat (if applicable) must <br />be approved by the City Council prior to the issuance of any building permits in connection with <br />the development. The number and type of dwelling units authorized, including the number of <br />bedrooms per dwelling unit by type, shall be as permitted for the zoning classification of Aall <br />permitted uses and/or conditional uses as set forth in the General Commercial District (conditional <br />uses will require a conditional use permit as set forth in Article 11 of the Zoning Code)@ and <br />ADwellings, garden apartment@ are designated as the permitted and conditional uses, and <br />consistent with Preliminary Development Plan Application P040039/40; except that the maximum <br />number of dwelling units shall not exceed 22 single bedroom units and 4 two-bedroom units. <br /> <br />Section 5. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty incurred by the violation of Chapter 34, nor bar the persecution of <br />any such violation. <br /> <br />Section 6. Any person, firm, or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalties provided in Chapter 34, <br />Section 34.115 of the University City Municipal Code. <br /> <br />Section 7. This ordinance shall take effect and be in force from and after its passage as <br />provided by law. <br /> <br />PASSED and ADOPTED this <br /> <br />JJ~ <br /> <br />daYOf~ <br /> <br />2005. <br /> <br />
