(SECTION 109 BOARD OF APPEALS) 109.1 General: In order to hear and decide appeals of orders, decisions or determinations made by the code official relative to the application and interpretation of this code, there shall be and is hereby created a Board of Appeals. 109.1.1 Limitation of authority: Delete in its entirety. 109.2 Application for appeal: Any person direcdy affected by an order decision or determination of the code official shall have the right to appeal to the Board of Appeals. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrecdy interpreted, the provisions of this code do not fully apply, or an equivalent form of construction can be used. 109.2.1 Qualifications: Delete in its entirety. 109.2.2 Alternate members: Delete in its entirety. 109.2.3 Chairman: Delete in its entirety. 109.2.4 Disqualification of member: Delete in its entirety. 109.2.5 Secretary: Delete in its entirety. 109.2.6 Compensation of members: Delete in its entirety. 109.3 Filing procedures: All appeals shall be f1led in writing with the code official within thirty (30) days after the order, decision or determination is rendered by the code official and shall state the grounds therefore. Appeals must be accompanied by a fee in the amount specified in Section 2.66.40 the University City Municipal Code. 109.4 Membership of board: The Board of Appeals shall consist of seven members appointed by the City Council. Board members shall be appointed for five year terms and serve until a successor has been appointed. 109.4.1 Qualifications of board members: At least three of the members shall each have at least ten (10) years experience as a registered architect, builder, superintendent of building construction or as a registered professional engineer with structural, civil or architectural .. . engmeermg experience. 3
