<br />A "closed place" is defined to mean a place where all doors are locked and where no patrons are in <br />the place or about the premises. <br /> <br />C. Nothing in this section shall be construed to prohibit the sale or delivery of any intoxicating liquor <br />during any ofthe hours or on any of the days specified in this section by a wholesaler licensed <br />under the provisions of Section 311.180 RSMo to a person licensed to sell the intoxicating liquor at <br />retail. <br /> <br />D. When January first, March seventeenth, July fourth, or December thirty-first falls on Sunday, and <br />on Sundays prior to Memorial Day and Labor Day and on the Sunday on which the national <br />championship game of the National Football League is played, commonly known as "Super Bowl <br />Sunday", any person having a license to sell intoxicating liquor by the drink may be open for <br />business and sell intoxicating liquor by the drink under the provisions of the license on that day <br />from the time and until the time which would be lawful on another day of the week, <br />notwithstanding any provisions of law to the contrary. <br /> <br />E. Any person licensed to sell intoxicating liquor under this article, who is licensed under the <br />provisions of Section 311.097 RSMo (restaurant bar) or 311.293 RSMo (package liquor) to sell <br />intoxicating liquor between the hours of 9:00 a.m. and midnight on Sunday, or who is licensed <br />under the provisions of Section 311.090 RSMo (certain tax -exempt organizations) to sell <br />intoxicating liquor between the hours of9:00 a.m. and midnight on Sunday and is a music school <br />licensed pursuant to Section 5.08.090(C)(4)(a), or who is licensed under the provisions of Section <br />311.102 RSMo (place of entertainment) to sell intoxicating liquor between the hours of 9:00 a.m. <br />and midnight on Sunday and is a movie theatre pursuant to Section 5.08.090(C)(4)(c), may apply to <br />the finance director for a license to sell intoxicating liquor on Sunday. A licensee under this <br />subsection shall pay to the finance director an additional fee of $300 per year for the privilege of <br />selling intoxicating liquor on Sunday, payable at the same time and in the same manner as its other <br />license fees. <br /> <br />F. Any person licensed to sell intoxicating liquor on Sunday pursuant to subsection E of this section <br />may be open for business and sell intoxicating liquor between 1 :00 p.m. and midnight on Sunday, <br />notwithstanding any provisions of law to the contrary. <br /> <br />G. Any person licensed to sell intoxicating liquor under this article, who is licensed under the <br />provisions of section 311.097 RSMo (restaurant bar) and subsection E of this section, may be open <br />for business and sell intoxicating liquor by the drink at retail for consumption on the premises <br />between the hours of 9:00 a.m. and midnight on Sunday, notwithstanding any provisions of the law <br />to the contrary. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation <br />from any penalty heretofore incurred by the violation of Section 5.08.090 or 5.08.240, nor bar the <br />prosecution for any such violation. <br /> <br />Section 3. Unless otherwise provided herein, any person, firm or corporation violating any of the <br />provisions of this ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter <br />1.12, Section 1.12.010 of the University City Municipal Code. <br /> <br />6 <br />
