BILL NO. '3'1<1 8 ORDINANCE NO.&c::io ~ AN ORDINANCE FIXING DEFERRED COMPENSATION TO BE PAID TO CERTAIN EMPLOYEES FROM AND AFTER JUNE 29, 2005; REPEALING ORDINANCE NO. 6446; AND CONTAINING AN EMERGENCY CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. From and after June 29, 2005, employees holding the positions of AssistantlDeputy City Manager, Director of Finance and Community Development, Director of Public Works, Director of Planning and Development, Director of Parks, Recreation and Forestry, Director of Human Resources, Director of Information Technology, and Public Relations Administrator shall be paid, by the City, additional deferred compensation in the amount of $38.46 per bi-weekly pay period under Section 457 of the Internal Revenue Code. Section 2. From and after October 8, 2003, employees holding the positions of AssistantlDeputy City Manager, Director of Finance and Community Development, Director of Public Works, Director of Planning and Development, Director of Parks, Recreation and Forestry, and Director of Human Resources, whose employment commenced on or after October 8, 2003, may elect to have additional deferred compensation in the amount of $76.92 per bi-weekly pay period, in addition to the $38.46 aforementioned in Section 1, under Section 457 of the Internal Revenue Code. This election shall be in lieu of participating in the Non-Uniformed Employees Retirement System and shall be made by the employee no later than the first day of his or her appointment to work by the City, and shall be irrevocable. Section 3. From and after June 29, 2005, employees holding the positions of Director of Information Technology and Public Relations Administrator, whose employment commences on or after June 29, 2005, may elect to have additional deferred compensation in the amount of $76.92 per bi-weekly pay period, in addition to the $38.46 aforementioned in Section 1, under Section 457 of the Internal Revenue Code. This election shall be in lieu of participating in the Non-Uniformed Employees Retirement System and shall be made by the employee no later than the first day of his or her appointment to work by the City, and shall be irrevocable Section 4. An emergency is hereby declared to exist in that it is anticipated that the positions of Director of Information Technology and Public Relations Administrator will be created and filled on or before June 29, 2005, so this ordinance is necessary for such employees to receive deferred compensation, as well as to fix the deferred compensation certain City employees for the next fiscal year. Section 5. This ordinance shall take effect and be in force from and after its passage as provided by law.
