'3'1<1 8 <br /> <br />ORDINANCE NO.&c::io ~ <br /> <br />AN ORDINANCE FIXING DEFERRED COMPENSATION TO BE <br />PAID TO CERTAIN EMPLOYEES FROM AND AFTER JUNE 29, <br />2005; REPEALING ORDINANCE NO. 6446; AND CONTAINING AN <br />EMERGENCY CLAUSE. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. From and after June 29, 2005, employees holding the positions of <br />AssistantlDeputy City Manager, Director of Finance and Community Development, <br />Director of Public Works, Director of Planning and Development, Director of Parks, <br />Recreation and Forestry, Director of Human Resources, Director of Information <br />Technology, and Public Relations Administrator shall be paid, by the City, additional <br />deferred compensation in the amount of $38.46 per bi-weekly pay period under Section <br />457 of the Internal Revenue Code. <br /> <br />Section 2. From and after October 8, 2003, employees holding the positions <br />of AssistantlDeputy City Manager, Director of Finance and Community Development, <br />Director of Public Works, Director of Planning and Development, Director of Parks, <br />Recreation and Forestry, and Director of Human Resources, whose employment <br />commenced on or after October 8, 2003, may elect to have additional deferred <br />compensation in the amount of $76.92 per bi-weekly pay period, in addition to the $38.46 <br />aforementioned in Section 1, under Section 457 of the Internal Revenue Code. This <br />election shall be in lieu of participating in the Non-Uniformed Employees Retirement <br />System and shall be made by the employee no later than the first day of his or her <br />appointment to work by the City, and shall be irrevocable. <br /> <br />Section 3. From and after June 29, 2005, employees holding the positions of <br />Director of Information Technology and Public Relations Administrator, whose <br />employment commences on or after June 29, 2005, may elect to have additional deferred <br />compensation in the amount of $76.92 per bi-weekly pay period, in addition to the $38.46 <br />aforementioned in Section 1, under Section 457 of the Internal Revenue Code. This <br />election shall be in lieu of participating in the Non-Uniformed Employees Retirement <br />System and shall be made by the employee no later than the first day of his or her <br />appointment to work by the City, and shall be irrevocable <br /> <br />Section 4. An emergency is hereby declared to exist in that it is anticipated <br />that the positions of Director of Information Technology and Public Relations <br />Administrator will be created and filled on or before June 29, 2005, so this ordinance is <br />necessary for such employees to receive deferred compensation, as well as to fix the <br />deferred compensation certain City employees for the next fiscal year. <br /> <br />Section 5. This ordinance shall take effect and be in force from and after its <br />passage as provided by law. <br />
