<br />(3) Minimum Rear Yard Setback: 30 feet <br /> <br />b. Other Permitted or Conditional Uses: The minimum setback requirements for all <br />other principal buildings shall be the same as listed in paragraph "a" above, <br />except that where a side yard of a non-dwelling use abuts a "SR" or "LR" zoned <br />property, then the minimum side yard setback shall be fifteen (15) feet. <br /> <br />3. Building Height Limitations: Except as provided for in Article 5, "Supplementary <br />Regulations," Section 34-54 (height exceptions), no principal building shall <br />exceed three and one-half stories or thirty-five (35) feet in height, whichever is <br />less. However, if a new structure exceeds the height (as defined in Article 2) of <br />the principal structure on abutting property by more than fifteen (15) feet, then the <br />side yard setback along the side in question shall be increased to eight feet. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any person, firm <br />or corporation from any penalty heretofore incurred by the violation of Section 34-30.5, <br />nor bar the prosecution for any such violation. <br /> <br />Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Sections <br />34.115.2 and 1.12.010 ofthe University City Municipal Code. <br /> <br />Section 4. An emergency is hereby declared to exist in that residential <br />neighborhoods need the immediate protection of the provisions of this ordnance. <br /> <br />Section 5.
