<br />INTRODUCED BY: <br /> <br />Ms. Welsch <br /> <br />DATE: 12/12/05 <br /> <br />BILL NO. <br /> <br />8834 <br /> <br />ORDINANCE NO. <br /> <br />6603 <br /> <br />AN ORDINANCE AMENDING CHAPTER 2.52 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO THE COMMITTEE FOR ACCESS AND <br />LOCAL ORIGINATION PROGRAMMING, BY REPEALING SECTION <br />2.52.050 THEREOF, RELATING TO MEMBERSHIP AND APPOINTMENT, <br />AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 2.52.050 MEMBERSHIP AND APPOINTMENT," THEREBY <br />AMENDING SAID SECTION SO AS TO REMOVE THE CITY MANAGER AS <br />AN EX OFFICIO MEMBER AND ADD AN EX OFFICIO MEMBER <br />APPOINTED BY THE HIGHER EDUCATION CONSORTIUM OF <br />METROPOLIT AN ST. LOUIS; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Chapter 2.52 ofthe University City Municipal Code, relating to the <br />Committee for Access and Local Origination Programming, is hereby amended by repealing <br />Section 2.52.050 thereof, relating to membership and appointment, and enacting in lieu thereof a <br />new section to be known as "Section 2.52.050 Membership and appointment," thereby amending <br />said section so as to remove the city manager as an ex officio member and add an ex officio <br />member appointed by the Higher Education Consortium of Metropolitan St. Louis; so that said <br />section, as so amended, shall read as follows: <br /> <br />2.52.050 Membership and appointment. <br /> <br />CALOP shall consist of seven voting members, appointed by the city council, who shall each <br />serve a three-year term. At least one of the seven voting members shall be selected from a group <br />of at least three nominees submitted to the city council by Charter Communications <br />Entertainment I, LLC, hereinafter referred to as the "company." The remainder of the members <br />shall be selected by the city council upon the recommendation by either members of the city <br />council, city staff or any resident citizen of the city. In addition to the seven voting members of <br />CALOP there shall be four nonvoting ex officio members: one will be a member of the city <br />council; one will be appointed by the company; one will be appointed by the University City <br />School District; and one will be appointed by the Higher Education Consortium of Metropolitan <br />St. Louis. Ex officio members shall receive all minutes of all meetings of CALOP, and may <br />submit written reports and recommendations. Ex officio members may comment during any <br />public discussion segment of any meeting. <br /> <br />Section 2. This ordinance shall not be construed so as to relief any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Chapter 2.52, Section <br />2.52.050, nor bar the prosecution for any such violation. <br />
