<br />INTRODUCED BY: <br /> <br />Ms. Brot <br /> <br />DATE: 01/09/06 <br /> <br />BILL NO. 8839 <br /> <br />ORDINANCE NO. 6606 <br /> <br />AN ORDINANCE IMPLEMENTING A TEMPORARY REDUCTION IN THE <br />LICENSE TAX ON THE GROSS RECEIPTS OF GAS COMPANIES WHICH <br />ARE DERIVED FROM CUSTOMERS IN UNIVERSITY CITY DURING THE <br />MONTHS OF FEBRUARY AND MARCH 2006; CONTAINING AN <br />EMERGENCY CLAUSE. <br /> <br />WHEREAS, the City Council of University City finds that severe weather predictions <br />and projections of extraordinary costs of natural gas for the 2005-2006 winter season will result <br />in a significant and abnormal increase in the financial burden borne by residential customers of <br />gas companies and that a temporary reduction in the license tax on the gross receipts derived <br />from residential customers in University City during the months of February and March 2006 <br />will help ease the burden and serve the public interest. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. The license tax imposed on gas companies pursuant to Chapter 5.36 of the <br />University City Municipal Code shall be reduced from nine percent (9%) to seven and one-half <br />(7.5%) on the gross receipts which are derived from residential customers in University City <br />from February I through March 31, 2006. The license tax rate shall remain at nine percent (9%) <br />for all gross receipts derived from non-residential customers, and shall be nine percent (9%) for <br />all gross receipts derived on or after April 1, 2006. <br /> <br />Section 2. The City Manager is hereby directed to inform Laclede Gas Company <br />of the provisions of this Ordinance and take such other measures as are required to <br />implement the same. <br /> <br />Section 3. The City Council finds that the actions directed by this Ordinance are <br />temporary in nature due to anticipated conditions in the winter season of 2005-2006. <br />Accordingly, no section in Chapter 5.36 of the University City Municipal Code shall be <br />recodified to reflect the temporary rate reduction in this Ordinance, and this Ordinance <br />shall not be construed or regarded as binding on or as precedent for future City Councils. <br /> <br />Section 4. An emergency is hereby declared to exist in that this Ordinance must <br />be passed immediately to allow sufficient time for the administrative actions necessary to <br />implement the provisions of this Ordinance. <br /> <br />Section 5. This ordinance shall take effect and be in force from and after its <br />passage as provided by law. <br /> <br />PASSED and ADOPTED this 9th day of January, 2006. <br />
