<br />INTRODUCED BY: Ms. Brat <br /> <br />DATE: 04/28/06 <br /> <br />BILL NO.: 8869 <br /> <br />ORDINANCE NO.: 6633 <br /> <br />AN ORDINANCE AMENDING 5.84 OF THE UNIVERSITY CITY <br />MUNICIP AL CODE, RELATING TO TELEPHONE AND TELEGRAPH <br />COMP ANIES, BY ENACTING THEREIN A NEW SECTION TO BE <br />KNOWN AS "SECTION 5.84.011 TELECOMMUNICATIONS LICENSE <br />TAX IMPOSED-AMOUNT;" CONTAINING EMERGENCY AND <br />SAVINGS CLAUSES. <br /> <br />WHEREAS, in 2005 the 93rd Missouri General Assembly enacted House Bill No. 209, known as the <br />"Municipal Telecommunications Business License Tax Simplification Act," Sections 92.074 to 92.098 <br />RSMo ("HB 209"); and <br /> <br />WHEREAS, no municipality may impose a business license tax on a telecommunications company <br />except as specified in HB 209; and <br /> <br />WHEREAS, HB 209 requires each municipality to promulgate and publish a telecommunications <br />business license revenue neutral tax rate for bills rendered on or after July 1, 2006; and <br /> <br />WHEREAS, such revenue neutral tax rate must be based upon the rate information each municipality <br />receives from the Missouri Director of Revenue; and <br /> <br />WHEREAS, by letter dated April 10, 2006, University City received rate information from the <br />Missouri Director of Revenue; and <br /> <br />WHEREAS, the Missouri Director of Revenue has calculated University City's telecommunications <br />business license revenue neutral tax rate to be four and three-tenths percent (4.3%), excluding the authorized <br />collection fee; and <br /> <br />WHEREAS, University City and other Missouri municipalities have filed lawsuits alleging that HB <br />209 is unconstitutional; and <br /> <br />WHEREAS, said lawsuits were dismissed by the trial courts; and <br /> <br />WHEREAS, University City and other Missouri municipalities timely filed appeals, which are <br />pending in the Missouri Supreme Court; and <br /> <br />WHEREAS, it is the intent of University City to comply with HB 209 while it is in effect, and at the <br />same time not waive University City's rights to challenge the constitutionality ofHB 209 and enforce <br />University City's existing ordinances on telephone business license taxes. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br />
