<br />INTRODUCED BY: Ms. Francine Brungardt <br /> <br />DATE: 05/01106 <br /> <br />BILL NO.: 8871 <br /> <br />ORDINANCE NO.: 6635 <br /> <br />AN ORDINANCE OPTING OUT OF THE STATE SALES TAX HOLIDA Y. <br /> <br />WHEREAS, Section 144.049 RSMo specifically exempts from State sales tax law <br />all retail sales of any article of clothing having a taxable value of one hundred dollars <br />($100.00) or less, all retail sales of school supplies not to exceed fifty dollars ($50.00) per <br />purchase, all computer software with a taxable value oftwo hundred dollars ($200.00) or <br />less, and all retail sales of personal computers or computer peripheral devices not to <br />exceed three thousand five hundred dollars ($3,500.00), during a three-day period <br />beginning at 12:01 a.m. on the first Friday in August and ending at midnight on the <br />Sunday following in each year; and <br /> <br />WHEREAS, Section 144.049 RSMo permits the governing body of any political <br />subdivision to adopt an ordinance to prohibit the provisions of Section 144.049 RSMo <br />from exempting sales that occur within the political subdivision from being subject to the <br />local sales taxes applicable to sales within the political subdivision; and <br /> <br />WHEREAS, the City of University City, Missouri desires to opt out of the so- <br />called "sales tax holiday." <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. The City of University City, Missouri hereby prohibits the <br />provisions of Section 144.049 RSMo from exempting sales that occur within University <br />City from being subject to the local sales taxes applicable to sales within University City <br />during the three-day period beginning at 12:01 a.m. on the first Friday in August and <br />ending at midnight on the Sunday following in each year; and <br /> <br />Section 2. The City Clerk is hereby directed to send written notice to the <br />Missouri Department of Revenue of the substance of this ordinance, which must be <br />received by the Missouri Department of Revenue prior to June 20, 2006. <br /> <br />Section 3. This ordinance shall take effect and be in force from and after its <br />passage as provided by law. <br />
