<br />INTRODUCED BY: Mr. Price <br /> <br />DATE: <br /> <br />9/18/06 <br /> <br />BILL NO. <br /> <br />8909 <br /> <br />ORDINANCE NO.: 6669 <br /> <br />AN ORDINANCE AMENDING CHAPTER 8.40 OF THE UNIVERSITY <br />CITY MUNICIPAL CODE, RELATING TO WEEDS, BY REPEALING <br />SECTION 8.40.030 THEREOF, RELATING ABATEMENT OF WEEDS- <br />SPECIAL TAX BILL CONSTITUTES LIEN, AND ENACTING IN LIEU <br />THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 8.40.030 <br />ABATEMENT OF WEEDS-SPECIAL TAX BILL CONSTITUTES LIEN," <br />THEREBY AMENDING SAID SECTION SO AS TO AUTHORIZE WEED <br />ABATEMENT AFTER FIVE DAYS IF THE PROPERTY WAS <br />PREVIOUSLY IN VIOLATION OF CHAPTER 8.40 DURING THE SAME <br />GROWING SEASON, AND TO MAKE THE PROVISIONS IN CHAPTER <br />8.24 AVAILABLE IN CERTAIN CASES; CONTAINING A SAVINGS <br />CLAUSE AND PROVIDING A PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Chapter 8.40 of the University City Municipal Code, <br />relating to weeds, is hereby amended by repealing Section 8.40.030 <br />thereof, relating to abatement of weeds-special tax bill constitutes lien, <br />and enacting in lieu thereof a new section to be known as "Section <br />8.40.030 Abatement of weeds-Special tax bill constitutes lien," so that <br />said section, as so amended, shall read as follows: <br /> <br />Section 8.40.030 Abatement of weeds-Special tax bill <br />constitutes lien. <br /> <br />A. Whenever weeds, in violation of Sections 8.40.010 or <br />8.40.020, are allowed to grow on any part of any lot or <br />ground within the city, the owner of the ground, or in case of <br />joint tenancy, tenancy by the entireties or tenancy in <br />common, each owner thereof shall be liable. The city <br />manager or his or her designee shall give a hearing after ten <br />days' notice thereof, either personally or by United States <br />mail to the owner or owners, or his or her or their agents, or <br />by posting such notice on the premises; thereupon the city <br />manager or designee may declare the weeds to be a <br />nuisance and order the same to be abated within five days; <br />and in case the weeds are not cut down and removed within <br />the five days, the city manager or designee may have the <br />weeds cut down and removed, and shall certify the costs of <br />the same to the city clerk, who shall cause a special tax bill <br />therefor against the property to be prepared and to be <br />collected by the director of finance, with other taxes <br />
