<br />Historic Registry but is not within a University City designated Historic District, as so <br />amended shall read as follows: <br /> <br />34-77.2 Referral to historic preservation commission. <br /> <br />1. Zoning Administrator Review. In examining an application for a building <br />permit to which Section 34-77.1 applies, the zoning administrator shall <br />determine if the enlargement, alteration, repair and/or construction is <br />deemed to require commission review in the regulations and standards <br />contained in the ordinance creating the specific historic landmark or <br />historic district. The zoning administrator may, when the ordinance does <br />not require referral, immediately approve issuance of a building permit but <br />shall thereupon notify the commission of such action. With regard to all <br />other applications for a building permit, the zoning administrator shall <br />forward a copy of the application to the historic preservation commission <br />for interpretation, advice and recommendations. All applications for <br />building permits pertaining to publicly owned historic landmark structures <br />or publicly owned structures within an historic district shall be referred to <br />the commission for interpretation, advice and recommendations. All <br />applications for building permits pertaining to structures within three <br />hundred (300) feet of an historic district or properties on the National <br />Historic Register shall be referred to the commission for interpretation, <br />advice and recommendations. However, applications pertaining to <br />structures or properties on the National Historic Register that are located <br />within private subdivisions that have their own review process for <br />construction and that are not located at University City designated <br />landmarks and/or within University City designated historic districts shall <br />not be referred to the commission. <br /> <br />Section 2. This ordinance shall not be construed to so as to relieve any <br />person, firm or corporation from any penalty heretofore incurred by the violation of <br />Section 34-77.2, nor bar the prosecution for any such violation. <br /> <br />Section 3. Any person, firm or corporation violating any of the provisions of <br />this ordinance, shall upon conviction thereof, be subject to the penalty provided in Title <br />1 Chapter 1.12.010 of the Municipal Code of the City of University City. <br /> <br />Section 4. This ordinance shall take effect and be in force from and after its <br />passage as provided by law. <br />
