<br />INTRODUCED BY Mr. Wagner <br /> <br />DATE: <br /> <br />January 8, 2006 <br /> <br />BILL NUMBER: 8921 <br /> <br />ORDINANCE NUMBER 6679 <br /> <br />AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, MISSOURI APPROVING A <br />MATER FIBER AGREEMENT WITHCHARTER COMMUNICATIONS. <br /> <br />WHEREAS, as a condition to University City's approval of Charter <br />Communications Entertainment I, LLC, assuming and renewing the cable television <br />franchise previously granted to Charter's predecessor in interest, Charter agreed to <br />construct an institutional fiber optic network to selected City sites for the City's internal <br />communications uses; and <br /> <br />WHEREAS, Charter built the network at its cost, with the City providing the <br />necessary equipment to "light" the network at the designated sites, but Charter and the <br />City could not agreed to the terms of the City's use of the network; and <br /> <br />WHEREAS, the City has used the network since 2002 without any compensation <br />being paid to Charter; and <br /> <br />WHEREAS, Charter has requested that the City enter into an agreement, on a <br />going-forward basis, for the City's use of the institutional network, and the City and <br />Charter now desire to enter into such an agreement; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCil OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI AS FOllOWS: <br /> <br />Section 1. <br /> <br />The City Manager is hereby authorized and directed to execute and enter into on <br />behalf of the City a Master Fiber Agreement for the City's use of an institutional fiber <br />optic communications network, the descriptions, terms, and conditions of which shall be <br />in substantial conformity with the attached Exhibit A, incorporated by reference. <br /> <br />Section 2. <br /> <br />It is hereby declared to be the intention of the City Council that each and every <br />part, section and subsection of this Ordinance shall be separate and severable from <br />each and every other part, section and subsection hereof and that the City Council <br />intends to adopt each said part, section and subsection separately and independently of <br />any other part, section and subsection. In the event that any part of this Ordinance shall <br />be determined to be or to have been unlawful or unconstitutional, the remaining parts, <br />sections and subsections shall be and remain in full force and effect. <br />
