INTRODUCED BY: Ms. Ricci DATE: June 18, 2007 BILL NO. 8938 ORDINANCE NO. 6693 AN ORDINANCE VACATING AND SURRENDERING ALL RIGHTS AND PRIVILlGES FOR THE USE OF THE SOUTHWEST FIVE FEET WIDE BY FIFTY EIGHT FEET LONG PORTION OF EXISTING EASEMENT LOCATED WITHIN LOT 23 OF BLOCK 4 OF THE UNIVERSITY TERRACE SUBDIVISION, KNOWN AS 7411 AMHERST AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, The above said portion of easement is located entirely within Lot 23, of Block 4 of the University Terrace Subdivision a subdivision within in the City of University City, in St. Louis County, Missouri; and WHEREAS, due notice of public hearing to be held by the City of University City council Chambers at City Hall on June 22,2007, at 6:30 p.m., to hear any comments concerning the proposed vacation of above said portion of easement, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on June 22, 2007 WHEREAS, said public hearing was held at the time and place specified in said notices, and all comments concerning the vacation of above said portion of easement were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The description of the portion of easement being vacated is described as follows: The portion of easement being vacated is rectangular shaped and is the approximately 5 feet wide x 58 feet long and is the southwestern portion of an approximately 10 foot wide x 150 feet long existing easement located adjacent to the east lot line of lot 23 and the west lot lines of lot 24, Lot 25, Lot 26, and Lot 27 of Block 4 of the University Terrace Subdivision; a subdivision located within the City of University City, Missouri, and recorded in Book 16, on Page 31 on April 12, 1922, in the records of the St Louis County Recorder of Deeds. The portion of easement being vacated is located entirely within the above said Lot 23. The description of the boundaries of the portion of easement being vacated is as follows. Beginning at the southeast corner of the above said Lot 23 and going 58 feet northward along the east lot line of said Lot 23 to a point, then going 5 feet west along a line being perpendicular to the east lot line of said lot 23 to a point, then going southward a distance of 58 feet along a line being parallel to the east lot line of said Lot 23 to a point lying on the north right of way of Amherst Ave. (50 feet wide), then going 5 feet east to the point of beginning.
