<br />INTRODUCED BY: Mr. Wagner <br /> <br />DATE: <br /> <br />November 5, 2007 <br /> <br />BILL NO. 8967 <br /> <br />ORDINANCE NO. 6721 <br /> <br />AN ORDINANCE IMPLEMENTING THE 2007 VIDEO SERVICES <br />PROVIDERS ACT BY ESTABLISHING ZONING REGULATIONS FOR <br />THE PLACEMENT OF VIDEO SERVICE FACILITIES ON PRIVATE <br />PROPERTY AND EXTENDING SUCH REGULATORY AUTHORITY <br />TO THE PLACEMENT OF ANY UTILITY FACILITIES ON <br />PRIVATE PROPERTY. <br /> <br />WHEREAS, the 94th General Assembly enacted S8284, codified as Sections <br />67.2675 through 67.2714 RSMo. and known as the "2007 Video Services Providers <br />Act," authorizes the limited regulation of such providers with regard to the location, <br />construction, and appearance of video service facilities on private property, among <br />other things; and <br /> <br />WHEREAS, the Council of University City (the "City") desires to retain and <br />implement such authority as remains to local governments under the 2007 Video <br />Services Providers Act by establishing zoning regulations governing the location, <br />construction, and appearance of video service facilities on private property; and <br /> <br />WHEREAS, the Council of University City further desires to extend the City's <br />regulatory authority over the location, construction, and appearance of other utility <br />facilities on private property, in addition to video service facilities, to enhance aesthetics <br />and protect the public health, safety and welfare, and to ensure equal treatment of all <br />facility owners under the City's law; and <br /> <br />WHEREAS, the City held a public hearing to consider the merits of this <br />Ordinance, after satisfying all publication and notice requirements established by law, <br />and all persons present at such hearings were given an opportunity to be heard and <br />were heard; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Article V, Supplementary Regulations, of Title 34, being the City's <br />Zoning Ordinance, is hereby amended by the enactment of a new Chapter 34-68, <br />entitled Utility Facilities Regulations, to read as follows: - <br /> <br />Title 34 <br /> <br />Zoning Code <br /> <br />Article V <br /> <br />Supplementary Regulations <br />
