<br />A. Every application for a news box license shall be <br />made to the director on forms provided by the director and shall be <br />accompanied by the required fee. The application form shall include <br />the distributor's contact information, which shall be kept current by <br />the distributor, and such other information as may be determined by <br />the director to ensure compliance with this chapter. The director <br />may adopt forms and procedures for bulk license applications. <br /> <br />B. Within seven (7) days of receipt of an application by <br />the director, the department of public works shall determine <br />whether the proposed location of the news box complies with <br />Section 5.100.XXX. If the proposed location complies with Section <br />5.100.XXX, the director shall issue a license. If the proposed <br />location does not comply, the director shall deny the application <br />and state the reasons for denial in writing. The director shall issue <br />or deny the license within seven (7) days of receipt of the receipt of <br />the department of public works' compliance determination. <br /> <br />C. Each news box license shall have a separate license <br />number for the administration of this chapter. The director may <br />impose provisions and conditions consistent with this chapter on <br />each news box license. <br /> <br />D. After receipt of a license, a distributor may install a <br />news box at the approved location in compliance with the license <br />so issued and this chapter. <br /> <br />Section 5.100.040 Location and Placement <br /> <br />No news box shall be placed, installed, located, used, or <br />maintained: <br /> <br />A. Within one and one half (1 1/2) feet of the face of any <br /> <br />curb; <br /> <br />B. Within five (5) feet of any fire hydrant; <br /> <br />C. Within five (5) feet of any marked crosswalk; <br /> <br />D. Within twelve (12) feet of the intersection of the <br />property lines at any street corner; <br /> <br />E. At any location where the width of the paved clear <br />space in any direction for the passage of pedestrians is reduced to <br />less than five (5) feet; <br />
