<br />INTRODUCED BY: <br /> <br />Ms. Brot <br /> <br />DATE: December 3,2007 <br /> <br />Bill NO. <br /> <br />8970 <br /> <br />ORDINANCE NO.: 6723 <br /> <br />AN ORDINANCE AMENDING CHAPTER 8.12 OF THE UNIVERSITY <br />CITY MUNICIPAL CODE, RELATING TO GARBAGE COLLECTION <br />AND DISPOSAL, BY REPEALING SECTION 8.12.220 THEREOF, <br />RELATING TO DELINQUENT BILLS-TRASH COLLECTION <br />STOPPED, AND ENACTING IN LIEU THEREOF A NEW SECTION TO <br />BE KNOWN AS "SECTION 8.12.220 DELINQUENT BILLS-TRASH <br />COLLECTION STOPPED", THEREBY AMENDING SAID SECTION <br />SO AS TO ESTABLISH NEW REGULATIONS ON THE <br />TERMINATION OF CITY REFUSE COLLECTION SERVICE; <br />CONTAINING SAVINGS AND SEVERABILITY CLAUSES, AND <br />PROVIDING A PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCil OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOllOWS: <br /> <br />Section 1. Chapter 8.12 of the University City Municipal Code, relating to <br />garbage collection and disposal, is hereby amended by repealing Section 8.12.220 <br />thereof, relating to delinquent bills-trash collection stopped, and enacting in lieu thereof <br />a new section to be known as "Section 8.12.220 Delinquent bills-trash collection <br />stopped", thereby amending said section so as to establish new regulations on the <br />termination of city refuse collection service; so that said section, as so amended, shall <br />read as follows: <br /> <br />8.12.220 Delinquent bills-Trash collection stopped. <br /> <br />If the owner of real property fails to pay the refuse collection charges in Section <br />8.12.200 and the bill becomes delinquent, the city shall terminate refuse collection <br />service for the property. Service that has been terminated shall not be resumed until <br />the delinquency and all penalties and interest are paid or the owner enters into an <br />approved plan with the director of finance to pay said amount, and the owner pays the <br />city a fee equal to the administrative cost to resume service. The director of finance is <br />authorized to waive part or all of the penalties and/or interest on such delinquency. The <br />director of finance is authorized to adopt and promulgate rules and regulations to <br />implement the provisions of this section to secure the intent thereof and to promote the <br />public health, safety, and general welfare. <br /> <br />Section 2. The sections, subsections, paragraphs, sentences, clauses and <br />phrases of this ordinance are severable, it being the intent of the City Council to comply <br />in all respects with the Constitution and laws of the State of Missouri. If a court of <br />competent jurisdiction shall adjudge to be invalid or unconstitutional anyone or more of <br />said sections, subsections, paragraphs, sentences, clauses or phrases, such judgment <br />or decree shall not affect, impair, invalidate or nullify the remainder of this ordinance <br />and shall be confined to the portions adjudged invalid or unconstitutional. <br />
