<br />INTRODUCED BY: Ms. Ricci <br /> <br />DATE: April ?, 2008 <br /> <br />BILL NO. 8989 <br /> <br />ORDINANCE NO. 6741 <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE <br />OF THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY <br />REPEALING SECTION 34-55(1)(4)(c) THEREOF RELATING TO <br />SETBACK REQUIREMENTS FOR AIR CONDITIONING UNITS, AND <br />ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 34-55.1 (4)(c)," BY AMENDING SAID SECTION SO AS TO <br />CHANGE THE DISTANCE FROM 2 FEET TO 1 FOOT; CONTAINING A <br />SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br />WHEREAS, at its meeting held at City Hall at 6:30 p.m. on March 26, 2008, the <br />University City Plan Commission recommended an amendment of Section 34-55.1 (4)(c) <br />of the University City Zoning Code by adding provisions that change the setback <br />requirement from 2 feet to 1 foot; and <br /> <br />WHEREAS, due notice of public hearings to be held by the City Council in the <br />City Council Chambers at City Hall at 6:30 p.m. on April 21, 2008, was duly published in <br />The Countian, a newspaper of general circulation within said City; and <br /> <br />WHEREAS, said public hearings were held at the time and place specified in <br />said notice, and all suggestions or objections concerning said amendment were duly <br />heard and considered by the City Council; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Chapter 34 of the Municipal Code of the City of University City, <br />Missouri, relating to zoning is hereby amended by repealing Section 34-55.1 (4)(c), <br />relating to setback requirements for air conditioning units, and enacting in lieu thereof a <br />new section to be known as "Section 34-55.1 (4)(c)," by amending said section so as to <br />change the setback from 2 feet to 1 foot, as so amended shall read as follows: <br /> <br />34-55.1 General setback exceptions. <br /> <br />Every part of a yard between the property lines and the required building setback <br />line shall be unoccupied and unobstructed by any structure or portion of a <br />structure from ground level of the graded lot upward, except for: <br />
