Any printed material offered tor distribution <br />through a news box, including but not limited to newspapers, <br />periodicals, magazines, and advertisements. <br /> <br />Right-of-way. The area ot any street, tree lawn, and sidewalk <br />dedicated tor public use. <br /> <br />Sidewalk. Any surface provided tor the use ot pedestrians. <br /> <br />Tree lawn. Any lawn area located between the curb or street <br />pavement and the sidewalk, or the lawn area between the street <br />pavement and the limit ot the public right-ot-way. <br /> <br />B. Permits Required; Fee; Existing Boxes <br /> <br />1. It is unlawful tor any distributor to locate, place, install, <br />stock, or maintain a news box in or on any sidewalk or public right- <br />ot-way without obtaining right-ot-way and news box inspection <br />permits, and paying accompanying tees, as provided by this <br />section. <br /> <br />2. Distributors shall obtain a right-ot-way permit and pay <br />the accompanying right-ot-way permit tee as provided in Section <br />12.04.070.G.1 ot this Code, except that a distributor (a) shall make <br />one bulk application tor all existing news boxes, and pay a single <br />right-ot-way permit tee, and (b) may make one bulk application, and <br />pay a single right-ot-way permit tee, tor multiple news boxes to be <br />installed contemporaneously. A right-ot-way permit shall expire tor <br />an approved location it the annual inspection tee tor the news box <br />at that location has not been paid. <br /> <br />3. Distributors shall also obtain a news box permit, and <br />pay an annual non-retundable permit tee, tor each box. Initial tees <br />shall be paid at the time ot applying tor a right-ot-way permit, and <br />thereafter shall be due every twelve (12) months trom the date ot <br />the right-ot-way permit. The director may adjust the tee trom time to <br />time consistent with Section 12.04.220.8.4. <br /> <br />4. The tees assessed in this subsection shall not exceed <br />the actual costs incurred by the city in processing permit <br />applications, inspecting news box installation sites, inspecting <br />installed news boxes (whether annually or on a complaint basis), <br />preparing inspection reports, and entorcing and administering this <br />Section 12.04.220. <br /> <br />Page 2 of7 <br />
