INTRODUCED BY: Mr. Crow DATE: March 23, 2009 BILL NO. 9036 ORDINANCE NO. 6780 AN ORDINANCE AMENDING CHAPTER 10.36 OF THE UNIVERSITY CITY MUNICIPAL CODE, RELATING TO REGULATIONS FOR SPECIFIC STREETS, BY REPEALING SECTION 10.36.190 THEREOF, RELATING TO THROUGH TRAFFIC PROHIBITED ON CERTAIN STREETS AT ALL TIMES OR DURING DESIGNATED HOURS AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 10.36.190 THROUGH TRAFFIC PROHIBITED ON CERTAIN STREETS AT ALL TIMES OR DURING DESIGNATED HOURS," THEREBY AMENDING SAID SECTION SO AS TO PROHIBIT THROUGH TRAFFIC AT ALL TIMES ON LIBERTY AVENUE FROM HANLEY TO THE NORTH CITY LIMITS; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE City of University City, MISSOURI, AS FOLLOWS: Section 1. Chapter 10.36 of the University City Municipal Code, relating to regulations for specific streets, is hereby amended by repealing Section 10.36.190 thereof, relating to through traffic prohibited on certain streets at all times or during designated hours, and enacting in lieu thereof a new section to be known as "Section 10.36.190 Through traffic prohibited on certain streets at all times or during designated hours," thereby amending said section so as TO PROHIBIT THROUGH TRAFFIC AT ALL TIMES ON LIBERTY AVENUE FROM HANLEY TO THE NORTH CITY LIMITS; so that said section, as so amended, shall read as follows: 10.36.190 Through traffic prohibited on certain streets at all times or during designated hours. A. Through traffic is prohibited during the hours of seven a.m. to nine a.m. and three-thirty p.m. to 6:00 p.m., Monday through Friday, between Olive Boulevard and Etzel Avenue, on Bartmer, Colby and Purcell Avenues. B. Through traffic is prohibited at all times on Arcadia Street between Pennsylvania and Partridge Avenues and on Liberty Avenue between Hanley Avenue and the North City Limits. C. The director of public works shall erect and maintain suitable signs giving notice that such through traffic is prohibited. E. It is unlawful for any person to operate a motor vehicle in violation of this section. (Ord. 6138 § 1, 1997: prior code § 21-174.3) Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Chapter 10.44, Section 10.44.020, nor bar the prosecution for any such violation. Section 3. Any person, firm or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, section 1.12.010 of the University City Municipal Code. Section 4. This ordinance shall take effect and be in force from and after its passage as provided by law.
