In order to hear and decide appeals of orders, decisions or determinations made <br /> by the code official relative to the application and interpretation of this code, there shall be and is <br /> hereby created a Board of Appeals. <br /> <br /> 111.91 Application for appeal. Any person directly affected by an order decision or <br /> determination of the code official shall have the right to appeal to the Board of Appeals. An <br /> application for appeal shall be based on a claim that the true intent of this code or the rules <br /> legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not <br /> fully apply, or an equivalent form of construction can be used. <br /> <br /> 111.92 Filing procedures. All appeals shall be filed in writing with the code official within <br /> thirty (30) days after the order, decision or determination is rendered by the code official and <br /> shall state the grounds therefore. Appeals must be accompanied by a fee in the amount specified <br /> in Section 2.66.040 the University City Municipal Code. <br /> <br /> 111.93 Membership of board. The Board of Appeals shall consist of seven members appointed <br /> by the City Council. Board members shall be appointed for five year terms and serve until a <br /> successor has been appointed. <br /> <br /> 111.93.1 Qualifications of board members. At least three of the members shall each have at <br /> least ten (10) years experience as a registered architect, builder, superintendent of building <br /> construction or as a registered professional engineer with structural, civil or architectural <br /> engineering experience. <br /> <br /> 111.94 Chairperson. The Board of Appeals shall annually select one of its members to serve as <br /> chairperson. <br /> <br /> 111.95 Notice of meeting. The meeting shall be upon notice from the chairperson, within thirty <br /> (30) days of the filing of an appeal, or at stated periodic meetings. <br /> <br /> 111.96 Board powers. The Board of Appeals may reverse, affirm or modify the order, decision <br /> or determination of the code official. <br /> <br /> <br /> <br /> <br /> <br /> 10 <br />
