<br /> <br /> <br /> <br /> <br /> <br /> INTRODUCED BY: Mr. Glickert DATE: November 16, 2009 <br /> <br /> <br /> BILL NO. 9056 ORDINANCE NO. 6801 <br /> <br /> <br /> AN ORDINANCE AMENDING CHAPTER 9.08 OF THE <br /> UNIVERSITY CITY MUNICIPAL CODE RELATING TO <br /> DRINKING ALCOHOL <br /> <br /> IN PUBLIC PLACES <br /> <br /> WHEREAS, the University City Police Department has experienced increasing <br /> behavioral problems with unregulated individuals and small groups consuming alcohol in <br /> City parks, resulting in police intervention and the discomfort and intimidation of other <br /> park users; and <br /> <br /> WHEREAS, the City Council desires to prohibit the unregulated consumption of <br /> alcohol in public places as provided herein; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 9.08, Offenses Against Public Peace and Decency, of the <br /> University City Municipal Code is hereby amended by the repeal of Section 9.08.080 and <br /> the enactment of a new Section 9.080.080 in lieu thereof, to read as follows: <br /> <br /> 9.08.080 Drinking in public places prohibited. <br /> <br /> A. No person shall drink any intoxicating liquor in or on the streets, <br /> sidewalks, parks, parkways, alleys, or parking lots of the city, or any other <br /> outdoor area open to the public for vehicular, pedestrian, or recreational use, <br /> whether publicly or privately owned, unless such public consumption takes place <br /> at a recreational or social event for which the Director of Parks, Recreation and <br /> Forestry has issued a public consumption permit. This section shall not apply to <br /> consumption at Ruth Park Golf Course, when intoxicating liquor is purchased <br /> from the course, or to sidewalk cafes duly licensed under this code. <br /> <br /> B. The Director of Parks, Recreation and Forestry shall prepare and maintain <br /> forms for permits for the privilege of public consumption as permitted herein and <br /> shall establish an application fee for the processing of same, not to exceed $10.00, <br /> for the recovery of the City's processing costs. The Director shall adopt <br /> reasonable regulations applicable to such consumption, which shall be stated on <br /> the permit, the violation of which shall be grounds for immediate permit <br /> revocation and the closing of the permitted event. <br />
