INTRODUCED BY: Mr. Glickert DATE: November 16, 2009 BILL NO. 9056 ORDINANCE NO. 6801 AN ORDINANCE AMENDING CHAPTER 9.08 OF THE UNIVERSITY CITY MUNICIPAL CODE RELATING TO DRINKING ALCOHOL IN PUBLIC PLACES WHEREAS, the University City Police Department has experienced increasing behavioral problems with unregulated individuals and small groups consuming alcohol in City parks, resulting in police intervention and the discomfort and intimidation of other park users; and WHEREAS, the City Council desires to prohibit the unregulated consumption of alcohol in public places as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 9.08, Offenses Against Public Peace and Decency, of the University City Municipal Code is hereby amended by the repeal of Section 9.08.080 and the enactment of a new Section 9.080.080 in lieu thereof, to read as follows: 9.08.080 Drinking in public places prohibited. A. No person shall drink any intoxicating liquor in or on the streets, sidewalks, parks, parkways, alleys, or parking lots of the city, or any other outdoor area open to the public for vehicular, pedestrian, or recreational use, whether publicly or privately owned, unless such public consumption takes place at a recreational or social event for which the Director of Parks, Recreation and Forestry has issued a public consumption permit. This section shall not apply to consumption at Ruth Park Golf Course, when intoxicating liquor is purchased from the course, or to sidewalk cafes duly licensed under this code. B. The Director of Parks, Recreation and Forestry shall prepare and maintain forms for permits for the privilege of public consumption as permitted herein and shall establish an application fee for the processing of same, not to exceed $10.00, for the recovery of the City's processing costs. The Director shall adopt reasonable regulations applicable to such consumption, which shall be stated on the permit, the violation of which shall be grounds for immediate permit revocation and the closing of the permitted event.
