<br /> <br /> <br /> <br /> <br /> <br /> INTRODUCED BY: Mr. Sharpe, Jr. DATE: April 12, 2010 <br /> <br /> <br /> BILL NO.: 9068 ORDINANCE NO.: 6811 <br /> <br /> <br /> AN ORDINANCE AMENDING CHAPTER 9.20 OF THE <br /> UNIVERSITY CITY MUNICIPAL CODE, RELATING TO <br /> OFFENSES BY OR AGAINST MINORS, BY ENACTING THEREIN <br /> A NEW SECTION TO BE KNOWN AS "SECTION 9.20.015 <br /> PARENTAL RESPONSIBILITY"; CONTAINING A SAVINGS <br /> CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br /> CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 9.20 of the University City Municipal Code, relating to <br /> offenses by or against minors, is hereby amended by enacting therein a new section to be <br /> known as "Section 9.20.015 Parental responsibility", which shall read as follows: <br /> 9.20.015 Parental responsibility. <br /> <br /> A. It shall be an ordinance violation for a parent, guardian or other person legally <br /> charged with the care or custody of a child less than seventeen (17) years old to fail or <br /> refuse to exercise reasonable care, supervision, protection or control over the child to <br /> prevent the child from becoming an abused, neglected or delinquent child, or in need of <br /> care or treatment, under State law, Chapters 210 and 211 RSMo. <br /> <br /> B. Whenever a child less than seventeen (17) years of age is arrested or detained for <br /> committing a crime or ordinance violation within the City, the Police Department, as <br /> soon as practicable, shall notify the parent, guardian or other person legally charged with <br /> the care or custody of the child of the arrest or detention, and shall advise such person of <br /> his or her responsibility under this ordinance. The Police Department shall keep a record <br /> of the notifications. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm <br /> or corporation from any penalty heretofore incurred by the violation of Chapter 9.20, nor <br /> bar the prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of this <br /> ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter <br /> 1.12, Section 1.12.010 of the University City Municipal Code. <br /> <br /> Section 4. This ordinance shall take effect and be in force from and after its <br /> passage as provided by law. <br />
