<br /> <br /> <br /> <br /> <br /> <br /> INTRODUCED BY: Mr. Kraft DATE: June 7, 2010 <br /> <br /> BILL NO. 9074 ORDINANCE NO.: 6816 <br /> <br /> <br /> AN ORDINANCE AMENDING CHAPTER 2.12.010 OF THE <br /> UNIVERSITY CITY MUNICIPAL CODE, RELATING TO THE <br /> APPOINTMENT OF THE CITY ATTORNEY <br /> <br /> <br /> <br /> WHEREAS, the Charter vests the City Council with the power to legislate <br /> ordinances under Section 16, and <br /> <br /> WHEREAS, the Charter enumerates certain other powers that vest solely in <br /> the Council under Section 17, and <br /> WHEREAS, the Council has a fiduciary duty to the people of the City of <br /> University City to carry out its functions, and <br /> <br /> WHEREAS, in order to carry out the above functions the Council is entitled to <br /> legal advice, and <br /> <br /> WHEREAS, in the interests of efficiency and effectuating the above, and <br /> <br /> WHEREAS, an ordinance is deemed necessary to make clear that the City <br /> attorney is appointed and answerable to the Council as a body, <br /> <br /> NOW THEREFORE BE IT RESOLVED BY the City Council of University City <br /> as follows: <br /> <br /> The City Council shall elect by majority vote a city attorney for the City, who shall <br /> hold office at the pleasure of the Council. The city attorney shall be licensed to <br /> practice law in the courts of the State of Missouri. <br /> <br /> This ordinance shall repeal and replace: 2.12.010 City Counselor to be director- <br /> <br /> Qualifications: <br /> The director of the law department shall be the City Counselor. <br /> The city counselor shall be duly licensed to practice law in the courts of the state. <br /> (Prior code § 2-20) <br /> <br /> PASSED this 21St day of June, 2010. <br />
