I <br /> I <br /> INTRODUCED BY: Mr. Kraft DATE: April 11, 2011 <br /> BILL NO.: 9111 ORDINANCE NO.: 6850 <br /> AN ORDINANCE AMENDING CHAPTER 2.10 OF THE UNIVERSITY CITY <br /> MUNICIPAL CODE, RELATING TO THE FINANCE DEPARTMENT, BY <br /> ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION <br /> 2.10.070 TRANSFER OF UNEXPENDED APPROPRIATIONS WITHIN A <br /> BUDGET CLASSIFICATION". <br /> WHEREAS, pursuant to Charter Article VI, a budget is adopted prior to the <br /> commencement of each fiscal year; and I <br /> i <br /> WHEREAS, pursuant to Charter Section 35, from the effective date of the budget the I <br /> several amounts stated therein as proposed expenditures become appropriated to the several <br /> objects and purposes named; and <br /> WHEREAS, pursuant to Charter Section 36, the budget contains separate provisions <br /> including an amount equal to the estimates of expenditure necessary for the administration, <br /> operation and maintenance of each office, department or agency of the City, itemized by <br /> character and object of expenditure; and <br /> WHEREAS, pursuant to Charter Section 38, the City Council may, by resolution at <br /> any time upon recommendation of a department head through the City Manager, transfer any <br /> unencumbered appropriation balance or portion thereof, from one classification of <br /> expenditures to another within an office, department or agency; and <br /> WHEREAS, also pursuant to Charter Section 38, at the request of the City Manager, <br /> the City Council may by resolution transfer any unencumbered appropriation balance or ' <br /> portion thereof from one office, department or agency to another; and <br /> WHEREAS, pursuant to Charter Section 19,the City Manager is the chief <br /> administrative officer of the City, and has the power and is required to prepare the budget <br /> annually and submit it to the City Council, and is responsible for its administration after <br /> adoption; and <br /> WHEREAS,the City Council desires to clarify the City Manager's authority to l <br /> transfer unexpended appropriations within a budget classification. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> Section 1. Chapter 2.10 of the University City Municipal Code, relating to the Finance g' <br /> Department, is hereby amended by enacting therein a new section to be known as "Section <br />
