INTRODUCED BY: Mr. Sharpe DATE: July 5, 2011 BILL NO.: 9121 ORDINANCE NO .6855 AN ORDINANCE AUTHORIZING THE GRANT, SALE AND CONVEYANCE OF AN EASEMENT IN FLYNN PARK TO UNION ELECTRIC COMPANY D/B/A AMEREN MISSOURI; CONTAINING AN EMERGENCY CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The City of University City,Missouri is the owner of property in Flynn Park shown hachured on the attached"Easement Plat',which is incorporated herein by reference,and more fully described as follows: A fifteen(15) feet wide by seventy-five(75)feet long strip of land being a part of and adjoining the north property lines of Lots 19 and 20 of Block 13 of University Hills Subdivision as per plat thereof recorded in Plat Book 18, Pages 22 and 23 of the St. Louis County Records. Locator number 18J230511. Section 2. In consideration of the sum of one dollar($1.00) and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged,the City of University City, Missouri authorizes the grant, sale and conveyance of an easement in said property shown hachured on the Easement Plat,subject to the terms and conditions set forth in the attached"Easement',which is incorporated herein by reference. Section 3. The City Manager is hereby authorized to enter into and execute on behalf of the City of University City, Missouri said Easement in substantially the form attached hereto, and all other documents in connection therewith,with such changes as the City Manager may approve. Section 4. It is hereby declared that an emergency exists in that construction of a development in Flynn Park and Flynn Park Elementary School is underway and cannot continue unless this ordinance is passed;and delay could cause financial hardship and adversely affect the public health, safety and welfare. Section 5. This ordinance shall take effect and be in force from and after its passage as provided by law.
