INTRODUCED BY: Mr. Crow DATE: July 5, 2010 <br /> BILL NO.: 9122 ORDINANCE NO.: 6856 <br /> AN ORDINANCE AUTHORIZING THE GRANT, SALE AND CONVEYANCE OF AN <br /> EASEMENT IN FLYNN PARK TO THE METROPOLITAN ST. LOUIS SEWER <br /> DISTRICT; CONTAINING AN EMERGENCY CLAUSE. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br /> MISSOURI, AS FOLLOWS: <br /> Section 1. The City of University City,Missouri is the owner of property in Flynn Park <br /> shown hachured on the attached"Exhibit A Match Line Sheet 1", which is incorporated herein <br /> reference,and more fully described as follows: <br /> Part of University Hills Subdivision, Plat Book 18, Pages 22 and 23, of the St. Louis <br /> County Records. Locator number 18J230511. <br /> Section 2. In consideration of the sum of one dollar($1.00) and other valuable consideration, <br /> the receipt and sufficiency of which is hereby acknowledged,the City of University City, <br /> Missouri authorizes the grant, sale and conveyance of an easement in said property shown <br /> hachured on Exhibit A Match Line Street 1 to the Metropolitan St. Louis Sewer District, subject <br /> to the terms and conditions set forth in the attached"Easement', which is incorporated herein by <br /> reference. <br /> Section 3. The City Manager is hereby authorized to enter into and execute on behalf of the <br /> City of University City, Missouri said Easement in substantially the form attached hereto, and all <br /> other documents in connection therewith, with such changes as the City Manager may approve. <br /> Section 4. It is hereby declared that an emergency exists in that construction of a <br /> development in Flynn Park and Flynn Park Elementary School is underway and cannot continue <br /> unless this ordinance is passed; and delay could cause financial hardship and adversely affect the <br /> public health, safety and welfare. <br /> Section 5. This ordinance shall take effect and be in force from and after its passage as <br /> provided by law. <br />
