INTRODUCED BY: Mr. Crow DATE: July 5, 2010 BILL NO.: 9122 ORDINANCE NO.: 6856 AN ORDINANCE AUTHORIZING THE GRANT, SALE AND CONVEYANCE OF AN EASEMENT IN FLYNN PARK TO THE METROPOLITAN ST. LOUIS SEWER DISTRICT; CONTAINING AN EMERGENCY CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The City of University City,Missouri is the owner of property in Flynn Park shown hachured on the attached"Exhibit A Match Line Sheet 1", which is incorporated herein reference,and more fully described as follows: Part of University Hills Subdivision, Plat Book 18, Pages 22 and 23, of the St. Louis County Records. Locator number 18J230511. Section 2. In consideration of the sum of one dollar($1.00) and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged,the City of University City, Missouri authorizes the grant, sale and conveyance of an easement in said property shown hachured on Exhibit A Match Line Street 1 to the Metropolitan St. Louis Sewer District, subject to the terms and conditions set forth in the attached"Easement', which is incorporated herein by reference. Section 3. The City Manager is hereby authorized to enter into and execute on behalf of the City of University City, Missouri said Easement in substantially the form attached hereto, and all other documents in connection therewith, with such changes as the City Manager may approve. Section 4. It is hereby declared that an emergency exists in that construction of a development in Flynn Park and Flynn Park Elementary School is underway and cannot continue unless this ordinance is passed; and delay could cause financial hardship and adversely affect the public health, safety and welfare. Section 5. This ordinance shall take effect and be in force from and after its passage as provided by law.
