appointment of a new regional tax increment financing commission, and thereafter <br /> the Council of University City, through City Ordinance No. 6758, adopted Section <br /> 2.34.050 of the City Code to implement Section 99.820 RSMo., which said new <br /> commission was intended to replace any existing commission for purposes of tax <br /> increment financing redevelopments considered and approved after August 28, <br /> 2008; and <br /> WHEREAS, both Section 99.820 RSMo. and Section 2.34.050 of the City Code <br /> included an exception authorizing the Commission "to vote or make <br /> recommendations relating to redevelopment plans, redevelopment projects, or <br /> designation of redevelopment areas, or amendments thereto that were the subject <br /> of a public hearing for which the required notice was given prior to August 28, <br /> 2008; and <br /> WHEREAS, in that the District and the Plan were created and approved in <br /> 1988, after the required public hearing on October 17, 1988, the Commission has <br /> the authority under Section 99.820 RSMo. and Section 2.34.050 of the City Code, to <br /> vote to continue and conclude its role in the implementation of the Plan by divesting <br /> itself of those assets acquired pursuant to its implementation of the Plan, and <br /> through the adoption of its resolution dated November 29, 2010, the Commission <br /> has done so; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> UNIVERSITY CITY, MISSOURI AS FOLLOWS: <br /> Section 1. The City Council of University City hereby: <br /> A. Ratifies the actions of the Commission taken with respect to the <br /> Plan's implementation; <br /> B. Clarifies that City Ordinance No. 6758 and Section 2.34.050 of the <br /> City Code were intended to permit the Commission to vote to wind up its business <br /> as provided herein; <br /> C. Accepts the transfer of the Parcels described in the attached Exhibit <br /> A and any other assets held in the Commission's or Authority's name; and <br /> D. Authorizes City staff to take such action as may be necessary to <br /> finalize and conclude the Commission's roles and responsibilities in the <br /> implementation and administration of the Plan; and <br /> E. Declares that upon completion of the tasks noted herein, the Y' <br /> Commission shall be immediately dissolved. <br /> r <br /> Section 2. Ordinances No. 5653, 5686, and 5687 of the City of University <br /> City are hereby amended to the extent necessary to comply with this Ordinance <br /> and are further restated and ratified to ensure the continued implementation of the <br /> s <br /> Page 2 of 3 <br /> r <br />
