(a) The Area qualifies as an area in need of redevelopment and that the <br /> redevelopment of the Area is necessary and in the interest of the public health, <br /> safety, morals and general welfare of the people of the City, all as permitted by <br /> and provided in the LCRA Law; <br /> (b) <br /> (c) The Plan is feasible and conforms to the City's Comprehensive Plan; <br /> (d) <br /> (e) The Plan contemplates new construction or rehabilitation of the designated real <br /> property in the Area; <br /> M <br /> (g) The Plan, having been duly reviewed and considered by the City Council, the <br /> Plan Commission, the LCRA, and their respective officers and staff, is hereby <br /> approved; and <br /> (h) HFHSL is hereby declared the redeveloper (the "Redeveloper") for <br /> t <br /> implementation of the Plan in accord with the LCRA Law. <br /> SECTION THREE. Relocation Assistance. The property within the Area is currently <br /> unoccupied. The Plan for the Area provides that no families will be displaced as a result of the <br /> Plan. If the property within the Area should become occupied, all eligible occupants displaced by <br /> HFHSL shall be given relocation assistance by HFHSL at its expense, in accordance with the <br /> Plan and all applicable federal, state and local laws, ordinances, regulations and policies. <br /> SECTION FOUR. Tax Abatement. On application, HFHSL shall be eligible to <br /> receive ten (10) years real property tax abatement pursuant to Sections 99.700 to 99.715 of the <br /> LCRA Law. <br /> 1 <br /> SECTION FIVE. Plan Modifications. Any proposed modification which will <br /> substantially change the Plan must be approved by the City Council in the same manner as the <br /> Plan was first approved. Modifications that will substantially change the Plan include, but are not <br /> necessarily limited to, modifications on the use of eminent domain, the length of tax abatement, <br /> the boundaries of the Area, or any other items which alter the nature or intent of the Plan. The <br /> Plan may be otherwise modified (e.g., urban design regulations, development schedule) by the <br /> LCRA with consent of the Redeveloper. <br /> k <br /> SECTION SIX. Severability. The sections of this Ordinance shall be severable. In <br /> the event that any section of this Ordinance is found by a court of competent jurisdiction to be <br /> invalid, the remaining sections of this Ordinance are valid, unless the court finds the valid <br /> sections of the Ordinance are so essential and inseparably connected with and dependent upon <br /> the void section that it cannot be presumed that this City Council would have enacted the valid <br /> sections without the void ones, or unless the court finds that the valid sections standing alone are <br /> t incomplete and are incapable of being executed in accordance with the legislative intent. <br /> SECTION SEVEN. Effective Date. This Ordinance shall take effect and be in force <br /> from and after its passage as provided by law. <br />
