INTRODUCED BY: Ms. Ricci DATE: October 3, 2011 <br /> BILL NO.: 9139 ORDINANCE NO.: 6871 <br /> AN ORDINANCE AMENDING SECTION 1.A OF ORDINANCE NO. 6869 SO AS TO <br /> CHANGE THE TAX RATE FOR GENERAL REVENUE PURPOSES FOR <br /> COMMERCIAL PROPERTY FOR THE YEAR 2011 FROM $0.680 TO $0.668 ON <br /> EACH $100.00 OF ASSESSED VALUATION; CONTAINING AN EMERGENCY <br /> CLAUSE. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br /> MISSOURI, AS FOLLOWS: <br /> Section 1. Section 1.A of Ordinance No. 6869 is hereby amended to read as follows: <br /> A. For general purposes a tax of$0.561 on residential property, a tax of$0.668 on <br /> commercial property and a tax of$0.680 on personal property, on each on hundred dollars <br /> ($100.00)of assessed valuation. <br /> Section 2. It is declared to be the intention of the City Council to comply with Missouri law <br /> on property tax rate ceilings and to levy a tax on said commercial property at the rate certified by <br />' the State Auditor. In the event that a court of competent jurisdiction declares the amendment to <br /> said commercial tax rate unconstitutional or invalid by a valid judgment or decree, or that the <br /> amendment affects the City's authority to levy a tax rate at the rate certified by the State Auditor, <br /> then the provisions of Ordinance No. 6869 shall continue in full force and effect, unaffected by <br /> the amendment, to extent allowed by law. <br /> Section 3. It is hereby declared that an emergency exists in that the City must immediately <br /> change said commercial property tax rate so that such rate and all other property tax rates comply <br /> with Missouri law and to levy taxes at the rates certified by the State Auditor. <br /> Section 4. This ordinance shall take effect and be in force from and after its passage as <br /> provided by law. <br /> 1 <br />
