LOUIS COUNTY RECORDER'S OFFICE. WHEREAS, on September 10, 2012 the City Council of University City adopted Resolution No. 2012-9, which approved a preliminary development plan for a mixed-use development project known as the Washington University—Loop Retail And Student Apartment Development in the PD-M Planned Development Mixed-Use Zoning District (the "Project"); WHEREAS, as so approved, the Project contemplated the vacation of a public walkway located between Lots 35 and 36 of Block 1 of North Parkview, per Plat Recorded in Plat Book 11 Page 4 of the St. Louis County Records for the purpose of constructing an elevator apartment associated with the Project; and WHEREAS, consistent with the approved Project, the City Council of University City now desires to vacate said public walkway, as more specifically described below and in the attached Exhibit A, incorporated herein by reference; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF UNIVERSITY CITY,AS FOLLOWS: Section 1. The 8' wide public walkway located between lots 35 and 36 of Block 1 of North Parkview is hereby vacated, said property being more specifically described in the attached Exhibit A and as follows: 1 COMMENCING AT THE INTERSECTION OF THE WEST RIGHT OF WAY LINE OF EASTGATE (50 FOOT WIDE) AVENUE WITH THE NORTH RIGHT OF WAY LINE OF AN ALLEY (15 FOOT WIDE); THENCE ALONG SAID NORTH RIGHT OF WAY LINE, NORTH 83 DEGREES 05 MINUTES 20 SECONDS WEST, A DISTANCE OF 442.32 FEET TO THE EAST RIGHT OF WAY LINE OF A WALK WAY (8 FOOT WIDE) AS DEPICTED IN NORTH PARKVIEW, A SUBDIVISION AS RECORDED IN PLAT BOOK 11, PAGE 4 OF THE ST. LOUIS COUNTY, MISSOURI RECORDER'S OFFICE; THENCE CONTINUING ALONG SAID NORTH RIGHT OF WAY LINE, NORTH 83 DEGREES 05 MINUTES 20 SECONDS WEST, A DISTANCE OF 8.00 FEET TO THE EAST LINE OF LOT 35 OF BLOCK 1 OF SAID NORTH PARKVIEW; THENCE ALONG SAID EAST LINE, NORTH 07 DEGREES 02 MINUTES 28 SECONDS EAST, A DISTANCE OF 125.15 FEET TO THE SOUTH RIGHT OF WAY LINE OF ENRIGHT (50 FOOT WIDE) AVENUE, FORMERLY VON VERSEN AVENUE; THENCE ALONG SAID SOUTH RIGHT OF WAY LINE, ALONG A CURVE TO THE LEFT, HAVING A RADIUS OF 2,861.60 FEET, WITH A CENTRAL ANGLE OF 00 DEGREES 09 MINUTES 37 SECONDS (WHICH CHORD BEARS SOUTH 82 DEGREES 57 MINUTES 32 SECONDS EAST, A CHORD DISTANCE OF 8.00 FEET) THROUGH AN ARC DISTANCE OF 8.00 FEET TO THE WEST LINE OF LOT 36 OF BLOCK 1 OF SAID NORTH PARKVIEW; THENCE ALONG SAID WEST LINE, SOUTH 07
