INTRODUCED BY: Mr. Sharpe DATE: March 11, 2013 <br /> BILL NO. 9180 ORDINANCE NO. 6911 <br /> AN ORDINANCE OF UNIVERSITY CITY, MISSOURI, REAFFIRMING <br /> THE LICENSE TAX TO BE IMPOSED ON THE GROSS RECEIPTS OF <br /> BUSINESS SUPPLYING OR FURNISHING ELECTRICITY OR GAS <br /> SERVICE CORPORATION CONDUCTING BUSINESS WITHIN THE <br /> CITY AND MATTERS RELATED THERETO; CONTAINING AN <br /> EMERGENCY CLAUSE. <br /> WHEREAS, the Missouri Public Service Commission ("PSC") has granted a tariff <br /> increase of 10.05 percent to Union Electric Company d/b/a Ameren Missouri ("Ameren <br /> Missouri"); and <br /> WHEREAS, tariff increases in excess of seven percent (7%) trigger certain requirements <br /> under Section 393.275 of the Revised Statutes of Missouri, as amended, to either roll back the <br /> rate of gross receipts taxes imposed by cities on Ameren Missouri or to pass an ordinance <br /> maintaining the existing rates despite the increase in the gross receipts to Ameren Missouri as a <br /> result of the tariff increase; and <br /> WHEREAS, Section 393.275 requires cities to roll back the rate of the business license <br /> gross receipts tax within sixty (60) days of the effective date of the tariff increase unless such <br /> cities pass an ordinance to maintain the existing rate; and <br /> WHEREAS, the PSC has established the effective date of the tariff increase granted to <br /> Ameren Missouri as January 13, 2013, and sixty (60) days from that date is March 14, 2013; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF UNIVERSITY <br /> CITY, MISSOURI, AS FOLLOWS: <br /> Section 1. The license tax on the gross receipts of businesses supplying electricity or <br /> gas services, including but not limited to Ameren Missouri, pursuant to Chapter 5.32 and 5.36 of <br /> the Municipal Code of University City shall be maintained at its existing rate as set forth and <br /> established in Sections 5.32.010 and 5.36.010, notwithstanding any tariff increase awarded by <br /> the PSC to Ameren Missouri, including but not limited to such increase purportedly effective on <br /> January 13, 2013. This ordinance shall be deemed to constitute the applicable exemption of the <br /> City from further application of rate adjustment requirements of Section 393.275.2 R.S.Mo. <br /> Section 2. There is hereby adopted a "No Automatic Adjustments" <br /> Pursuant to Section 393.275 R.S.Mo., and other applicable authority, the City shall maintain now <br /> and herein after, unless otherwise provided by law, the tax rates of its license taxes on the gross <br /> receipts of businesses supplying electricity or gas services, including as imposed pursuant to <br /> Sections 5.32.010 and 5.36.010, as may be amended from time to time, without reduction, <br />
