I <br /> INTRODUCED BY: Mr. Sharpe DATE: March 11, 2013 <br /> I <br /> BILL NO. 9178 ORDINANCE NO. 6912 <br /> I <br /> AN ORDINANCE AMENDING TITLE 9 "PUBLIC PEACE, MORALS AND <br /> WELFARE," CHAPTER 9.08 "OFFENSES AGAINST PUBLIC PEACE AND <br /> DECENCY" OF THE MUNICIPAL CODE OF UNIVERSITY CITY BY <br /> ENACTING A NEW SECTION RELATIVE TO PROTESTS AT FUNERALS. <br /> WHEREAS, a copy of the proposed Ordinance has been made available for public inspection <br /> prior to its consideration by the City Council. <br /> I <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF UNIVERSITY <br /> CITY, AS FOLLOWS: <br /> Section 1: Title 9 "Public Peace, Morals and Welfare," Chapter 9.08 "Offenses Against <br /> Public Peace and Decency" of the Municipal Code of University City is hereby amended by enacting <br /> a new Section 9.08.290 entitled "Funeral Protests Prohibited" to read as follows: <br /> SECTION 9.08.290 Funeral Protests Prohibited: 1 <br /> 1 <br /> A. Every citizen may freely speak, write and publish the person's sentiments on all <br /> subjects, being responsible for the abuse of the right, but no person, association, or <br /> corporation shall picket or engage in other protest activities within three hundred (300) ° <br /> feet of any residence, cemetery, funeral home, church, synagogue, or other establishment <br /> during or within one (1) hour before or one (1) hour after the conduct of any actual t <br /> funeral or burial service at that place. <br /> I <br /> B. As used in this Section, "other protest activities"means any action that is disruptive or i <br /> undertaken to disrupt or disturb a funeral or burial service. <br /> C. As used in this Section, 'funeral" and "burial service" mean the ceremonies and <br /> memorial services held in conjunction with the burial or cremation of the dead, but this <br /> Section does not apply to funeral or burial service processions,in transit beyond any three <br /> hundred (300) foot zone that is established under Subsection (A) above. <br /> I <br /> Section 2: Any ordinances or part of ordinances in conflict with this ordinance are hereby I <br /> repealed. <br /> i <br /> i <br /> Section 3: All other sections and subsections of Chapter 9.08 shall remain in full force <br /> and effect. € <br /> i <br /> i <br /> 1 <br /> i <br /> k <br /> i <br /> i <br />
