2.62.730 Proration of Benefits <br /> If at any time hereafter the retirement fund created pursuant to this chapter (disregarding <br /> the portion credited to investment accounts) shall be insufficient to pay in full all the <br /> benefits provided by this chapter (other than Section 2.62.407) to those at the time being <br /> entitled to such benefits, the amount then on hand and available for payment of benefits <br /> shall be prorated among the beneficiaries so that all beneficiaries shall receive the same <br /> percentage of their full monthly benefits. <br /> 2.62.740 Right of Council to Reduce Appropriation. <br /> The appropriation set forth in Section 2.62.620.A is the maximum which the council is <br /> authorized to apply for the operation of the plan set forth in this chapter but the council <br /> may, in its sole discretion, appropriate a lesser amount upon receipt of a written report of <br /> the competent actuary that a lower rate will maintain the fund and provide the payment of <br /> benefits hereunder. <br /> 2.62.750 Limitation of Liability of City <br /> In no event shall anything in this chapter be held or construed to impose upon the city <br /> any duty or liability in excess of the funds appropriated for the purpose herein specified <br /> and the payment thereof to the board of trustees. <br /> ::ODMA\PCDOCS\SL01\4757582\3 <br />
