The <br />applicants shall submit designs for the wall to be approved by the Zoning <br />Administrator. <br /> <br />13. <br /> <br />A detailed landscaping plan shall be submitted to the School District with a copy <br />sent the Director of Planning and Development for review and approval, in <br />conjunction with a review by the City Forester. Landscaping shall be installed <br />and maintained in accordance with the approved plan. <br /> <br />14. <br /> <br />The flagpole shall be designed and constructed to accommodate at least one <br />additional user. <br /> <br />Mr. Munkel moved approval. Ms. Colquitt seconded the motion. <br /> <br />Responding to Mr. Wagner, Mr. Ollendorff responded that the pole will actually function <br />as a flag pole. <br /> <br />Responding to Mr. Wagner's question about indemnification of the company and <br />lightning safety, Mayor Adams asked the representative of the applicant to come <br />forward to answer questions. <br /> <br />Mr. OIlendorff stated that the City did not require any indemnification. It does have to <br />be appropriately designed to meet our building code. It has to be structurally sound <br />and designed to collapse inward. <br /> <br />Peter Newton, CIS Communication, is agent for OmniPoint Communications, the <br />applicant. Mr. Newton stated that every site within their network is indemnified up to $2 <br />million by the underwriters. The poles are designed to collapse on themselves. The <br />tower has all the equipment cables buried in an underground conduit. It is completely <br />grounded and designed for lightning strikes. <br /> <br />Responding to Mr. Lieberman, Mr. Newton stated that other communications <br />companies could lease space on the tower per City ordinance. The lighting for the pole <br />will be separately metered and fused. The school board will incur zero costs. <br /> <br />Responding to Mr. Schoomer's question about who would be responsible for removing <br />the tower if the owners go out of business, Mr. Newton said that the City did not require <br />a performance bond, but other cities do. A performance bond can be drawn on incase <br /> <br /> <br />
