Session 1799
December 18, 2000

AGENDA #2 - HARRISON AVENUE PROPERTY VACATING:

A public hearing is scheduled for 7:30 p.m. this date and place to hear comments on
the proposal to vacate two parcels of land on the west side of Harrison between Wayne
Ave. and Hawthorne Place. Adjacent owners have requested consideration of this
matter and the City staff reports that there is no apparent public need for this property.
Following the public hearing, Council may adopt an ordinance on this matter.

Mayor Adams opened the public hearing at 7:35 p.m.

Mr. Lieberman asked if the adjacent owners had indicated any willingness to accept the
maintenance of this property. Mr. Ollendorff said that the adjacent owner made the
request and has already cleaned up the property and has also planted on it. They are
maintaining it. Mr. Lieberman interjected that this was for two parcels of land. He
asked if the second parcel had been spoken for by its adjacent owner.

Gregory Rose, Deputy City Manager, has not heard from the other adjacent owner
regarding their willingness or unwillingness to maintain this property. Public hearing
notices were distributed to each adjacent owner. Mr. Lieberman wants the other owner
contacted and a definite answer from them on whether they will ac~;ept the
maintenance of this property before the next council meeting. He will ask for the bill to
be delayed prior to second and third reading later this evening.

Mayor Adams closed the public hearing at 7:41 p.m.

AGENDA #3 - VACATING RIGHT-OF-WAY ON SHAFTESBURY AT RAISHER:

A public hearing has been set for 7:30 p.m. this date and place to receive comments on
the proposed vacating of excess public street right-of-way on the north side of
Shaftesbury adjacent to 7860 Drexel Drive. Since there is no public: benefit from
ownership of this property and considerable public liability from said ownership, it
appears to be in everyone's best interest to vacate this property. A bill has been
introduced carrying out this action and may be voted on at such time as the Council
deems appropriate.

Mr. Ollendorff commented that the City is keeping 10' behind the curb for a future
walkway.

Mayor Adams opened the public hearing at 7:39 p.m.

Mr. Dmitri Chapman, 7860 Drexel, stated that he understands the concern about the
walkway and he does like the idea of a walkway behind his home. His property is
