<br /> <br />Board of Adjustment <br />December 15, 2014 Meeting Minutes <br />(approved 1-20-15) <br /> <br />A Board of Adjustment meeting was held on Monday December 15, 2014 at the Heman Park <br />Community Center located at 975 Pennsylvania Ave., University City, Missouri. The meeting <br />commenced at 6:40 pm. <br /> <br />1. Approval of Minutes <br />The minutes from the October 20, 2014 Board of Adjustment meeting were approved. <br /> <br />3. Case # 14-13063 244 Linden Avenue <br />Jeff Nornberg with Nornberg and Associates, on behalf of Daniel and Anne Miller (property owners), <br />requested a variance to maintain a front yard setback of five (5) feet in lieu of fifteen (15) feet from the <br />northern property boundary as required by Section 400.1070 of the Zoning Code for proposed <br />construction of a two-story detached garage on the residential lot in the SR Single Family Residential <br />District. <br /> <br />The applicant explained the proposal and noted that the shape of the existing lot and location of the <br />existing house created a hardship by limiting the space available to construct a detached garage. The <br />applicant and board members discussed the location of the existing one-story detached garage, which <br />did not comply with the setback requirements from the northern and eastern property lines. Board <br />members noted that the shape of the lot was a condition unique to the property, but expressed concern <br />that the requested action may have been created by the property owner. Board members also discussed <br />the orientation of the proposed garage in relation to Kingsbury Boulevard, to the north, and the need <br />for the second story as opposed to the existing one-story detached garage. <br /> <br />Staff explained that due to the location of the property in a local historic district (Linden-Kingsbury <br />Historic District), the request was reviewed by the Historic Preservation Commission (HPC) at their <br />November 20, 2014 meeting. The HPC recommended to the Board of Adjustment that a minimum <br />setback of ten (10) feet be maintained, rather than the five (5) feet as requested by the applicant, in <br />keeping with the character and scale of other structures within the historic district. Board members <br /> <br /> <br />The variance was approved by a vote of 5 to 0 with the condition that a minimum setback of ten (10) <br />feet be maintained for the proposed detached garage. <br /> <br />4.
