MINUTES OF THE UNIVERSITY CITY COUNCIL

April 28, 2006

At a Special Session of the City Council of University City held in Board Room of the City
Library, located at 6701 Delmar Boulevard on Friday, April 28, 2006, Mayor Adams called
the meeting to order at 2:00 p.m. In addition to Mayor Adams, the following members of
Council were present:

Ms. Stefany Brot
Mr. Arthur Sharpe, Jr.
Ms. Francine Brungardt
Mr. Byron Price

Mr. Wagner and Mr. Glickert had excused absences.
Also in attendance was City Attorney, John Mulligan Jr...

The agenda for the meeting, so stated on the Notice posted, was to discuss the
emergency passing of an
ORDINANCE AMENDING 5.84 OF THE UNIVERSITY CITY
MUNICIPAL CODE, RELATING TO TELEPHONE AND TELEGRAPH COMPANIES, BY
ENACTING THEREIN A NEW SECTION TO BE KNOWN AS “SECTION 5.84.011
TELECOMMUNICATIONS LICENSE TAX IMPOSED-AMOUNT;” CONTAINING EMERGENCY
.
AND SAVINGS CLAUSES

Ms. Brot requested farther clarification. She noticed that her wireless invoice had a local
tax charge on it and wanted to know if tax is being collected now. It was explained to her
that it varies from wireless carrier to carrier. A lot of issues are still being worked out in
court but each municipal has to have an ordinance in place by end of month in order to
qualify for tax percentage, no matter what the court’s ruling is. After one year of reviewing
the receipts, cities are allowed a one-time adjustment, in July 2007. Without an ordinance
in place, the city would get nothing.

Ms. Brot introduced Bill No. 8869 — AN ORDINANCE AMENDING 5.84 OF THE
UNIVERSITY CITY MUNICIPAL CODE, RELATING TO TELEPHONE AND TELEGRAPH
COMPANIES, BY ENACTING THEREIN A NEW SECTION TO BE KNOWN AS
“SECTION 5.84.011 TELECOMMUNICATIONS LICENSE TAX IMPOSED-AMOUNT,”
CONTAINING EMERGENCY AND SAVINGS CLAUSES.

Bill No. 8869 received its first reading

There being no farther communication, Bill No. 8869 was given its second and third
readings.
