BILL NO. 8324 INTRODUCED BY COUNCILMEMBER SCHOOMER ORDINANCE NO. 6106 AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, MISSOURI, EXTENDING THE TERM OF FRANCHISE WITH TCI CABLE PARTNERS OF ST. LOUIS, L.P. TO JUNE 23, 1999, AND CONTAINING AN EMERGENCY CLAUSE. WHEREAS, TCI Cable Partners of St. Louis, L.P., a Colorado limited partnership (TCICP), is the current holder and operator of a non-exclusive cable television franchise granted by the City of University City, Missouri pursuant to a transfer from Continental Cablevision of St. Louis, L.P. (Continental); and WHEREAS, Continental and the City properly commenced proceedings during the six month period begming with the 36th month before franchise expiration pursuant to 47 USC § 546 (a) and properly continue to conduct such proceedings with the purpose of considering possible renewal of the franchise; and WHEREAS, passage of this Ordinance will not in any way alter the City's powers to continue conducting the proceedings under 47 USC 546 (a) (which proceedings shall not be concluded until the City provides written notice of such conclusion to the holder of the franchise) and otherwise conduct formal and informal franchise renewal proceedings under 47 USC § 546; and WHEREAS, the transfer of the franchise caused a delay in completing proceedings under 47 USC § 546 due to the change in operators and personnel, and the City and TCICP have been unable to properly complete negotiations before expiration of the extended franchise and, therefore, an extension of the franchise expiration date to 11:59 p.m. on June 23, 1999, is necessary and in the best interest of the City and its residents; and WHEREAS, based upon the foregoing information, representations, and circumstances, the City Council has concluded that it is in the best interest of the City and its residents and businesses to grant consent to extend the term of the franchise subject to certain conditions. NOW, THEREFORE, BE IT ORDA1NED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Extension of Franchise Tenn. The terms of the cable television franchise granted by the City to Continental which was transferred to TCI Cable Partners of St. Louis is hereby extended so as to expire at 11:59 p.m. on June 23, 1999. The continued operation of the cable system by TCICP shall be deemed consent to this extension. Section 2. Emergency Clause: Effective Date. This is an emergency ordinance. An emergency exists because the franchise is due to expire before the City's next Council meeting.
