Session 1808
April 23, 2001

Mr. Schoomer moved adoption with all conditions as stipulated by the City Manager,
with a condition that the front setback conform with the Board of Adjustment decision, if
application is made, but no less than 37 feet, which will be made without prejudice. Mr.
Sharpe seconded the motion.

Mary Ellen Shortland, 7303 Northmoor, stated she was concerned with the large decks
on these three story tall buildings which will put a very blunt end on their yards, which
they are not used to. The people living in these new units will be looking straight into
their back yards.

Mary Schlafiy, 7317 Northmoor, stated that the balconies were going to extend past the
rear of the buildings by ten feet. She states that this is not acceptable. She doesn't
understand why the balconies are allowed to extend past the main building setback.
She says that these huge decks will be overlooking straight into their houses and into
their backyards. No landscape plan could possibly shield them from a three story
building with those balconies and the invasion of privacy.

Gerry Banet, 7304 Northmoor, stated that he was concerned with the public health of
his neighborhood. He believes this can be a win-win situation. He believes this is good
for the City and the developer, but it is important to develop it where it is good for the
neighborhood. They are concerned about the large trees that will be gone to put in this
development. They want to make sure that they are suitably replaced. He is also
concerned with the size of the balconies and the invasion of privacy. He would hope
that something suitable could be worked out.

Nardi Hobler, 7307 Northmoor, stated that they do take the recommendation of the City
Council very seriously, because of the possible recommendation to the Board of
Adjustment. The biggest concern of the neighbors is privacy and the proximity of this
structure. They are asking for a 3' variance in the setback. They do not see this as
being extreme nor negatively impacting future development. The neighbors feel very
strongly about this and wish that the Council would be more weight on the setback
issue. They will wait to plead their case further in front of the Board of Adjustment. The
neighbors also wish to request that verification of all conditions have been met prior to
any occupancy permits being issued.

Christina O'Sullivan, 7321 Northmoor, stated that she is hear to lend support to the
setback proposal. She is concerned with the proximity of the project to the abutting
neighbors. She would like to see as large as possible buffer between the two.

Melissa Losos, 7311 Northmoor, stated that she is also in favor of 3' setback variance.
She supports everything that the other neighbors before her have said.

8
