Session 1808
April 23, 2001

Martin King, 7330 Northmoor, stated that he is also in support of the setback proposal.
doe Erker, 7315 Northmoor, stated that he is also in support of the setback proposal.
He believes Phase 1 and Phase 2 should both be moved up 3 feet for continuity.

Martha Kuhn, 7310 Northmoor, agrees with the setback proposal and urges Council to
take seriously their concerns.

Ado Hasselbring, 6812 Grayside Ridge Ct., owns 7318Forsyth, the property in between
the two developments. He says that U. City had put him in an extreme disadvantage,
because he was not notified of Phase 1. He learned about when a sign went up two
doors down from him. This will be affecting him tremendously and he has just learned
about this and has had no input in it at all. Phase 1 looks awful. He can't see how this
is going to assist the value of his property.

Paul Berry, 2 St. Alfred Rd, Olivette, is the architect for the developer. Mr. Berry gave
an overview of the assistance and communication that has occurred between the
developers, himself and the neighbors.

Responding to Mr. Ollendorff, Mr. Berry stated that they are satisfied with the structure
as proposed, because it does meet the City's code requirement. They are willing to
submit this amendment to the Board of Adjustment for the setback variance, per the
neighbors wishes. Mr. Ollendorff said that the fee for the application will be waived.
Mr. OIlendorff also cautioned Mr. Berry to make sure that the developers keep the
project and development areas clean and mowed.

Responding to Mr. Lieberman's several questions, Berry stated that the construction for
Phase 1should begin the first of June. Depending on sales of units in the first building,
will determine the Phase 2 construction. The value of the structure will be around $3 -
$4 million.

Mark Mehlman, developer for the project, responding to Mr. Lieberman, stated that their
acquisition and construction loans are in place and they are moving ahead with Phase
1. Mr. Mehlman said that they would do a better job with the cleanliness and upkeep
on the project site. Phase 2 should start going up around September, if all goes as
planned.

Responding to Mr. Munkel, Mr. Berry said that they are proposing to pave the alley 208
feet, which is the first parcel to the east and then 160 lineal feet which is property line of
this parcel.

Responding to Mr. Lieberman, Mr. Ollendorff said that if Mr. Schoomer's motion is
approved, the Council is agreeing to abide by the outcome of the Board of Adjustment's

9
