Session 1808 <br />April 23, 2001 <br /> <br />decision. The neighbors want the variance to be decided and the developer will file the <br />application to be heard. Responding further to Mr. Lieherman, Mr. Ollendorff said that <br />the setback requirements in the zoning code have different requirements. Windows, <br />decks and balconies can be a certain percentage within a required setback. Mr. Berry <br />said that there are open space requirements on these types of project, as well. <br /> <br />Responding to Mr. Munkel commented that it looks like the whole first story on the west <br />side is going to be below street level on Northmoor. At that end, then you are only <br />talking about a two story building relative to Northmoor. This detail has been <br />overlooked. Responding to Mr. Munkel, Mr. Berry stated that the additional 3 feet that <br />they neighbors will just provide a minimum of extra privacy. Mr. Munkel stated that he <br />believes that the developer has been very generous in making concessions. He really <br />thinks that the 3 feet that the neighbors want is really minimal and is really without <br />merit, in his opinion. He urges the Council to vote against the variance. <br /> <br />The motion to approve passed 5 to 2, with Mr. Munkel and Ms. Colquitt voting Nay. <br /> <br />CITY CLERK'S DOCKET: <br /> <br />BILLS FOR SECOND AND THIRD READING: <br /> <br />1.
