Session 1808
April 23, 2001

decision. The neighbors want the variance to be decided and the developer will file the
application to be heard. Responding further to Mr. Lieherman, Mr. Ollendorff said that
the setback requirements in the zoning code have different requirements. Windows,
decks and balconies can be a certain percentage within a required setback. Mr. Berry
said that there are open space requirements on these types of project, as well.

Responding to Mr. Munkel commented that it looks like the whole first story on the west
side is going to be below street level on Northmoor. At that end, then you are only
talking about a two story building relative to Northmoor. This detail has been
overlooked. Responding to Mr. Munkel, Mr. Berry stated that the additional 3 feet that
they neighbors will just provide a minimum of extra privacy. Mr. Munkel stated that he
believes that the developer has been very generous in making concessions. He really
thinks that the 3 feet that the neighbors want is really minimal and is really without
merit, in his opinion. He urges the Council to vote against the variance.

The motion to approve passed 5 to 2, with Mr. Munkel and Ms. Colquitt voting Nay.

CITY CLERK'S DOCKET:

BILLS FOR SECOND AND THIRD READING:

1.
