Session 1503, Minutes Page 9 <br />September 18, 1989 <br /> <br />Mr. Schocmer moved approval of tb~ site plan as amended. Mrs. Schuman second- <br />ed the motion, which carried unanimbusly. <br /> <br />8600 OI~IVE B~JLEVARD <br /> <br />~ City Manager said Mr. Patrick jx~14, operator of Nuz-Pudz, 8600 Olive, has <br />requested a license to sell beer for consumption on ~dle premises by food cus- <br />turners. There will be no beer carry-out or delivecy. He said the application <br />is in order and the business has been operating with no problems, so Council <br />may act as it dee~s appropriate. <br /> <br />Mr. Price moved approval with the restriction that beer delivery and carry-out <br />will not be permitted. Mrs. RT,~,~son seconded the motion. <br /> <br />Mr. Schoomer asked if it would not be more appropriate to attach the above re- <br />striction to the site plan. Mr. Ollendorff said the ban on delivery can be <br />attached to the license, but the ban on carry-out is legal only if attached to <br />the site plan. <br /> <br />Mrs. Schuman said she was opposed to the sale of beer on the premises or in <br />any other way because it was primarily a delivery and carry-out business which <br />has only four e~_hles. She felt approval would set a precedent for every small <br />sandwich shop to do the same thing, which would be undesirable. Mr. Wagner <br />shared Mrs. Schu~man's concerns, and said it would not significantly benefit <br />this business unless there is a drastic change such as an expansion. Mr. O1- <br />ler~_~orff said he would check to see if the site plan permitted an expansion. <br />Mrs. Schuman recalled that an earlier amendment permitting an outdoor patio <br />was approved, but it was never built. <br /> <br />Mr. Wagner moved to ~ahle this matter until more information is forthcoming <br />regarding the site plan restrictiors on expansion. Mrs. Schuman seconded the <br />motion. All voted Aye except Mayor Majerus and Mr. Schoomer, who voted Nay. <br />The Mayor asked that Council consider this matter at the next meeting. <br /> <br />USE ~ - 6610 DELMAR <br /> <br />· he City Manager said the Medicare-Glaser store at 6610 Delmar has requested <br />that their conditional use permit be amended to allow them to stay open until <br />midnight instead of 10 p.m., and to open at 7 a.m. instead of 8 a.m. He be- <br />lieved that Council's concern was about the sale of alcoholic beverages ~arly <br />and late in the day. He said there were several choices--deny any change; ac- <br />ce~t _Me~_ icare-Glaser's request; or accept the ~ed hours, but not allow <br />the sale of alcoholic beverages during the extended hours. He rec~m~_nded ap- <br />proval of the longer hours. <br /> <br />Mr. ~a~s ~oved approval for discussion purposes. Mrs. Tho1~son seconded the <br />motion. Mr. ~rl~ms did not object to extending the hours, but did not want ii- <br />liquor sold later in the evening. He also asked that the changes suggested by <br />the Special Benefit Tax District be incorporated in the approval, especially <br />the removal of paper window signs. He then moved to amend his motion to allow <br />the requese~ extended hours, but with no liquor sales after 10 p.m. or before <br />9 a.m., and including the changes ~ed by the Special Benefit Tax <br /> <br /> <br />
