C. Distributions under this section shall be made in accordance with the <br /> Internal Revenue Code, Section 401(a)(9), and the regulations thereunder. <br /> D. Effective for distributions after December 31, 1992, a distributee may <br /> elect to have any portion of an eligible rollover distribution paid directly to <br /> an eligible retirement plan specified by a qualified distributee in a direct <br /> rollover as provided in Section 2.64.530. <br /> 2.64.410 Early Service Retirement <br /> A. Any member may retire on his or her retirement date after attaining early <br /> retirement age upon the member's written application to the board of <br /> trustees not less than thirty (30) days nor more than ninety (90) days prior <br /> to such date. <br /> B. Upon retirement at the member's early service retirement date the member <br /> shall receive benefits under either subsection (B)(1) or (2) of this section: <br /> 1. A pension beginning on the member's normal service retirement <br /> date calculated as for normal service and final average <br /> compensation as of the member's early service retirement date; or <br /> 2. A pension beginning on the day after the employee retires from the <br /> city's service and prior to his or her normal service retirement date <br /> which is the actuarial equivalent of the pension under subsection <br /> (B)(1)of this section. <br /> 2.64.420 Disability Retirement <br /> A. There shall be a disability insurance policy approved by the city council <br /> which covers members. The policy premiums shall be paid from the <br /> nonuniformed employees retirement fund. <br /> B. Should a member receiving disability insurance payments again become <br /> an employee the employee's disability insurance payments shall cease and <br /> the employee shall immediately become a member of the retirement <br /> system as of the date of re-employment. His or her creditable service at the <br /> time of his or her disability shall be restored in full force and effect unless <br /> the member has withdrawn his or her accumulated contributions as <br /> permitted under Section 2.64.407.
