from the United States government as a result of illness contracted or injuries sustained <br /> while in military service, may, at the option of the board of trustees, be required to waive <br /> any disability insurance payments under Section 2.64.420, which may be determined by <br /> medical examination to be due directly or indirectly to an injury or illness resulting from <br /> or growing out of military service of such applicant, but only to the extent of the amount <br /> of disability compensation received by the applicant from the United States government. <br /> 2.64.424 Reduction of Benefits for Compensation Under Workmen's <br /> Compensation Law <br /> If an employee or an employee's dependents are entitled to benefits under this chapter and <br /> likewise to benefits under the workmen's compensation law as the result of the same <br /> injury, the benefits payable under this chapter shall be reduced in the manner prescribed <br /> by the statutes of the state, and if there is no applicable statute, then the adjusted benefits <br /> as herein defined shall be reduced by the amount of the similar benefits paid under the <br /> workmen's compensation law. The adjusted benefits are the benefits under the plan <br /> multiplied by the ratio of the city's normal cost to the total contributions of the city and <br /> employees in the preceding fiscal year as computed by the actuary. The board of trustees <br /> shall have full right to apply the provisions of the plan in such equitable manner as it <br /> determines. <br /> 2.64.430 Death Benefits <br /> A. If the membership of an employee is terminated by reason of death prior <br /> to the member's normal retirement age and the member's retirement date, <br /> the amount of the employee's accumulated contributions shall be payable <br /> in a lump sum to the employee's designated beneficiary, plus a death <br /> benefit of one hundred thousand dollars ($100,000.00) payable as <br /> provided under the terms and conditions of a standard term life insurance <br /> policy if approved by the city manager and purchased with funds in the <br /> nonuniformed employees retirement fund, and if the city manager has <br /> elected not to purchase such a policy, the death benefit shall be payable <br /> from the nonuniformed employees retirement fund to the extent payment <br /> would be made under a standard term life insurance policy. <br /> B. If the membership of an employee is terminated by reason of the <br /> member's death after the member's normal retirement age but prior to the <br /> member's actual retirement,the member's accumulated contributions shall <br /> be payable in a lump sum to the member's designated beneficiary. If the <br /> deceased member's designated beneficiary is his or her surviving spouse, <br /> they may elect to receive in lieu of the member's accumulated <br /> contributions a pension payable for life computed as if a member had <br /> retired on the day of the member's death and had elected the optional form <br /> of pension set forth in Section 2.64.515. <br /> Restated Nonuniformed Pension Plan—City of University City Page 13 <br />
